Chandradhar Goswami & Ors. v. The Gauhati Bank Ltd.
- Court: Supreme Court Of India
- Year: 1966
Key Legal Principles
A person cannot ordinarily be charged with liability merely on the basis of an entry in a bank's books of account when the underlying transaction is disputed.
A certified copy of a bank account under Section 4 of the Bankers’ Books Evidence Act does not have greater evidentiary effect than the original entry itself.
Therefore:
Bank entry → relevant evidence
Certified bank entry → admissible/valuable evidence in accordance with the Bankers’ Books Evidence Act
But:
Bank entry alone → insufficient to establish disputed liability under Section 34
Independent evidence of the underlying transaction is required where the transaction is disputed.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
The appellants, through their karta, maintained an open, mutual and current account with The Gauhati Bank Ltd. They borrowed money from the bank and also made payments into the account.
A mortgage deed was subsequently executed in favour of the bank in respect of the existing liability. The bank alleged that, after execution of the mortgage, a further amount of ₹10,000 had been advanced to the appellants.
The appellants disputed this further advance.
The bank relied upon its books of account and a certified copy of the relevant account entry to establish the alleged ₹10,000 advance.
The trial court decreed the bank's suit and the High Court upheld the decree. The matter then reached the Supreme Court.
2. Legal Issue
Whether a bank can establish a disputed loan or advance merely by producing an entry in its books of account or a certified copy of that entry under Section 4 of the Bankers’ Books Evidence Act, 1891.
A further issue concerned whether the bank could rely upon an entry showing payment of ₹100 for extending limitation.
3. Court's Decision
The Supreme Court held that the appellants could not be saddled with liability for the disputed ₹10,000 merely on the basis of the bank's account entry.
Section 34 of the Indian Evidence Act provides that entries in regularly kept books of account are relevant, but such entries alone are not sufficient to charge a person with liability.
The Court further held that Section 4 of the Bankers’ Books Evidence Act gives certified copies of bank records evidentiary value, but only to the same extent as the original entries would have been admissible.
Therefore, a certified copy of a bank entry does not become conclusive proof of the underlying transaction.
The bank had to produce independent evidence establishing that the ₹10,000 was actually advanced. Since it failed to do so, that part of the claim could not be upheld.
The Court also held that the suit was within limitation in respect of the mortgage liability, but the bank's claim for personal liability was barred by limitation.
4. Court's Reasoning
Section 34 of the Evidence Act does not prohibit the use of account entries as evidence. It makes regularly maintained account entries relevant.
However, the section expressly provides that such entries alone cannot be sufficient to charge a person with liability.
The Supreme Court therefore distinguished between:
(a) proving that an entry exists in the bank's books; and
(b) proving that the underlying transaction actually occurred.
Section 4 of the Bankers’ Books Evidence Act facilitates production of certified copies of bank records. Such certified copies become prima facie evidence of the existence of the original entries and the matters recorded therein, but only to the extent that the original entries themselves would be legally admissible.
Therefore, if the borrower disputes the transaction, the bank must produce additional evidence showing that the money was actually advanced.
Once such independent evidence is produced, the account entry can operate as corroborative evidence.
In the present case, the bank did not produce sufficient independent evidence proving the alleged ₹10,000 advance. Consequently, the disputed amount could not be recovered merely on the strength of the account entry.
The Court also considered the limitation issue and held that the mere entry showing payment of ₹100 did not satisfy the statutory requirements for acknowledgement or part-payment because the necessary writing/signature contemplated by the Limitation Act had not been proved.
5. Relevance to Co-operative Banks
This principle is highly relevant to co-operative banks because recovery proceedings frequently depend upon bank records such as:
• loan account statements;
• ledger extracts;
• debit entries;
• disbursement entries;
• interest calculations;
• payment entries;
• certified copies of accounts;
• loan vouchers and transaction records.
A co-operative bank should not assume that producing a certified statement of account will automatically prove every disputed component of the borrower's liability.
If a borrower specifically denies receiving a particular loan amount or disbursement, the bank should be prepared to produce supporting evidence such as:
• sanction letter;
• loan agreement;
• disbursement voucher;
• cheque or transfer record;
• payment instruction;
• borrower acknowledgement;
• security documents;
• correspondence;
• evidence of the bank officer connected with the transaction.
6. Practical Application
For a co-operative-bank recovery lawyer, this case is particularly useful when preparing evidence in a recovery suit.
Before filing a recovery proceeding, the bank should identify disputed debit entries and ensure that the underlying transactions can independently be proved.
The certified statement of account remains important evidence, but it should not be treated as a substitute for proof of the underlying transaction where the borrower specifically disputes the advance.
The case is also important in limitation disputes. A bank should not rely merely upon an internal account entry showing an alleged payment or adjustment to establish extension of limitation. The statutory requirements relating to acknowledgement or part-payment must independently be satisfied.
Practical rule:
A bank's books of account are relevant evidence, but a disputed loan transaction cannot ordinarily be proved by the account entry alone. Independent evidence of the underlying advance or transaction should be produced.
Summary (Kannada)
• Loan account statement;
• Ledger extract;
• Debit entries;
• Disbursement entries;
• Interest calculation;
• Payment entries;
• Certified copies of accounts;
• Sanction letter;
• Loan agreement;
• Disbursement voucher;
• Cheque ಅಥವಾ bank-transfer record;
• Payment instruction;
• Borrower acknowledgement;
• Security documents;
• Correspondence;
Certified statement of account
