Deposit Insurance & Credit Guarantee Corporation v. Ragupathi Ragavan & Ors.

  • Court: Supreme Court Of India
  • Year: 2015

Key Legal Principles

When DICGC pays the insured amount to depositors of an insured bank, DICGC acquires the statutory right to recover that amount from the Official Liquidator under Section 21 of the DICGC Act.

The Official Liquidator must comply with Section 21 and Regulation 22 and cannot distribute the relevant amount contrary to that statutory mechanism.

The Supreme Court also held that there cannot be another preferential claim ahead of the amount payable to DICGC under Section 21, subject to the statutory provisions governing liquidation expenses and dividend.

Key Legal Principles (Kannada)

Summary (English)

1. Facts

The case concerned Theni Cooperative Urban Bank Ltd., a cooperative bank in Tamil Nadu. The bank was an insured bank under the Deposit Insurance and Credit Guarantee Corporation Act, 1961.

Because the bank was facing financial difficulties, the Reserve Bank of India cancelled its banking licence under Section 22 of the Banking Regulation Act, 1949. The bank was subsequently ordered to be wound up and an Official Liquidator was appointed.

DICGC paid the insured amount to the bank's depositors. At the relevant time, the maximum amount insured for each depositor was ₹1 lakh.

The issue arose regarding the money remaining with the Official Liquidator after DICGC had paid the insured amount. The High Court directed that the available money should be distributed among depositors instead of being repaid to DICGC.

DICGC challenged that direction before the Supreme Court.

2. Legal Issue

Whether, after DICGC has paid the insured amount to depositors of a failed cooperative bank, the Official Liquidator is legally required to repay that amount to DICGC before making further distributions to other depositors or creditors.

3. Court's Decision

The Supreme Court allowed DICGC's appeal.

The Court held that Section 21(2) of the DICGC Act makes it obligatory for the Official Liquidator to repay to DICGC the amount paid by DICGC to the depositors, subject to the statutory scheme.

The Court further held that the statutory provision operates notwithstanding anything contrary contained in any other law.

Therefore, the High Court was not correct in directing the Official Liquidator to distribute the relevant amount among the depositors by ignoring Section 21 of the DICGC Act.

4. Court's Reasoning

The Court explained that the purpose of the DICGC Act is to protect depositors of banking companies, including cooperative banks, from losing their insured deposits when a bank faces financial difficulty and is ultimately wound up.

Section 16 provides for insurance of deposits up to the prescribed limit.

Once DICGC makes the statutory payment to depositors, Section 21(2) requires the Official Liquidator to repay the amount to DICGC.

The Supreme Court specifically noted that Section 21(2) contains an overriding provision. The Official Liquidator therefore cannot ignore the statutory obligation and distribute the same amount to another creditor or depositor.

The Court also referred to Regulation 22, which governs the manner and timing of repayment to DICGC from the amounts realised by the liquidator.

The Court therefore concluded that the High Court had exceeded its authority by directing distribution contrary to the statutory scheme.

5. Relevance to Co-operative Banks

This judgment is especially relevant because the failed bank involved in the case was itself a cooperative urban bank.

It is useful for understanding what happens when a cooperative bank:

• loses or has its banking licence cancelled;

• enters liquidation;

• has its depositors' claims submitted to DICGC;

• receives payment from DICGC on behalf of insured depositors; and

• subsequently realises money from borrowers or from the sale of its assets.

The judgment establishes that such recovered funds cannot simply be distributed by the liquidator according to his own assessment of competing claims. The statutory mechanism under the DICGC Act must be followed.

6. Practical Application

For a cooperative-bank lawyer, this case is useful when dealing with:

• liquidation of a cooperative bank;

• DICGC claims;

• disputes between DICGC and depositors;

• distribution of liquidation proceeds;

• recovery of loans after the bank has gone into liquidation;

• claims by depositors exceeding the insured amount;

• priority of DICGC's statutory recovery;

• consequences of cancellation of a cooperative bank's banking licence.

Practical rule:

Once DICGC has paid the insured amount to depositors, the liquidator must account for DICGC's statutory right under Section 21. The fact that DICGC has already paid the depositors does not extinguish DICGC's right to recover the amount from the liquidation estate.

Summary (Kannada)

ಈ ಬ್ಯಾಂಕ್ Deposit Insurance and Credit Guarantee Corporation Act, 1961 ಅಡಿಯಲ್ಲಿ ವಿಮೆಗೊಂಡ ಬ್ಯಾಂಕ್ ಆಗಿತ್ತು.

ನ್ಯಾಯಾಲಯವು Deposit Insurance and Credit Guarantee Corporation General Regulations, 1961 ರ Regulation 22 ನ್ನೂ ಪರಿಗಣಿಸಿತು.

• ಬ್ಯಾಂಕಿಂಗ್ ಪರವಾನಗಿಯನ್ನು ಕಳೆದುಕೊಂಡಾಗ;

• liquidation ಗೆ ಒಳಪಟ್ಟಾಗ;

• DICGC ಗೆ ಠೇವಣಿದಾರರ claims ಸಲ್ಲಿಸಿದಾಗ;

• DICGC insured amount ಅನ್ನು ಠೇವಣಿದಾರರಿಗೆ ಪಾವತಿಸಿದಾಗ;

• ನಂತರ ಸಾಲಗಾರರಿಂದ ಹಣ ವಸೂಲಿ ಮಾಡಿದಾಗ ಅಥವಾ ಬ್ಯಾಂಕಿನ ಆಸ್ತಿಗಳನ್ನು ಮಾರಾಟ ಮಾಡಿ ಹಣ ಪಡೆದಾಗ;

• ಸಹಕಾರಿ ಬ್ಯಾಂಕಿನ liquidation;

• DICGC claims;

• DICGC ಮತ್ತು ಠೇವಣಿದಾರರ ನಡುವಿನ ವಿವಾದ;

• liquidation proceeds ಹಂಚಿಕೆ;

• ಬ್ಯಾಂಕ್ liquidation ಗೆ ಒಳಪಟ್ಟ ನಂತರ ಸಾಲ ವಸೂಲಿ;

• insured amount ಗಿಂತ ಹೆಚ್ಚಿನ ಠೇವಣಿ ಹೊಂದಿರುವ ಠೇವಣಿದಾರರ claims;

• DICGC ಯ statutory recovery ಯ priority;

• cooperative bank ನ banking licence ರದ್ದಾದ ಪರಿಣಾಮಗಳು.

DICGC ಠೇವಣಿದಾರರಿಗೆ insured amount ಅನ್ನು ಪಾವತಿಸಿದ ನಂತರವೂ DICGC ಯ statutory recovery right ಮುಂದುವರಿಯುತ್ತದೆ.
