Jagdish Singh v. Heeralal & Ors.
- Court: Supreme Court Of India
- Year: 2013
- Neutral citation: 2013 INSC 734
Key Legal Principles
The core principle is:
Where a grievance concerns a measure taken by a secured creditor under Section 13(4) of the SARFAESI Act, the remedy ordinarily lies before the DRT under Section 17, and the jurisdiction of the civil court is barred by Section 34.
The expression "any person" in Section 17 is broad and is not confined to the borrower.
Accordingly, third parties or persons claiming an interest in the secured property may also be required to approach the DRT when their grievance arises from a SARFAESI enforcement measure.
IMPORTANT LIMITATION:
The judgment concerns the statutory bar under Section 34 in relation to matters falling within the DRT's jurisdiction. It should not be read as eliminating every conceivable civil-court jurisdiction in every dispute merely because a bank is involved. The precise nature of the relief and the subject matter of the dispute remain important.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
Bank of India had granted a loan of Rs.25 lakhs to M/s Guru Om Automobiles. The loan was secured by an equitable mortgage created by depositing the original title deeds of certain immovable properties with the bank.
The borrowers defaulted in repayment. The bank issued a notice under Section 13(2) of the SARFAESI Act and subsequently took measures under Section 13(4).
The secured property was auctioned and the appellant, Jagdish Singh, became the highest bidder. The auction was confirmed by the bank and the entire auction price was paid.
Thereafter, certain members of the borrower's family filed a civil suit claiming that the property was joint Hindu family/HUF property and that the borrowers had no exclusive right to mortgage or auction it.
The bank objected that the civil court had no jurisdiction because the dispute related to measures taken under Section 13(4) of SARFAESI and the statutory remedy was before the DRT under Section 17.
The High Court nevertheless held that the civil court could examine the title/HUF dispute.
The matter reached the Supreme Court.
2. Legal Issue
Whether a civil court can entertain a suit challenging or interfering with measures taken by a secured creditor under Section 13(4) of the SARFAESI Act when Section 17 provides a remedy before the Debts Recovery Tribunal and Section 34 bars civil-court jurisdiction over matters which the DRT/DRAT is empowered to determine.
3. Court's Decision
The Supreme Court allowed the appeal and set aside the High Court judgment.
It held that the civil court's jurisdiction is barred in respect of matters arising from measures taken by a secured creditor under Section 13(4) of the SARFAESI Act where the aggrieved person has a remedy under Section 17 before the DRT.
The Court also held that the expression "any person" in Section 17 is wide enough to include persons other than the borrower, including persons claiming an interest in the secured asset.
Therefore, a person claiming an interest in property affected by SARFAESI enforcement cannot ordinarily bypass the statutory DRT remedy by filing a civil suit concerning the SARFAESI measures.
4. Court's Reasoning
Section 13(4) permits the secured creditor to take specified measures for recovery, including taking possession of secured assets and transferring them by lease, assignment or sale.
Section 17 provides a statutory remedy to any person aggrieved by those measures.
The Supreme Court emphasised that the expression "any person" is deliberately broad. It is not restricted to the borrower. It can include a guarantor, auction-related claimant, or another person whose rights are affected by the SARFAESI measure.
Section 34 expressly excludes civil-court jurisdiction in matters which the DRT or DRAT is empowered to determine.
The Court therefore held that when the grievance concerns the legality of a Section 13(4) measure, the proper statutory forum is the DRT rather than the civil court.
The Court also relied on the overriding effect given to SARFAESI by Section 35 where there is inconsistency with another law.
In the present case, the alleged HUF/joint-family claim was being used to challenge the bank's enforcement and auction of the secured property. Since the dispute related to the SARFAESI enforcement measure, the statutory DRT mechanism applied.
5. Relevance to Co-operative Banks
This judgment is highly useful to co-operative banks undertaking SARFAESI recovery.
A common problem is that after the bank takes possession or conducts an auction, the borrower, family members, co-owners, alleged HUF members, purchasers or other claimants may approach the civil court seeking:
• declaration that the mortgage is invalid;
• declaration that the secured property belongs to an HUF;
• injunction against possession;
• injunction against auction;
• challenge to the bank's sale;
• challenge to other measures taken under Section 13(4).
Jagdish Singh provides strong authority for the proposition that a dispute concerning the legality of a Section 13(4) measure should ordinarily be pursued before the DRT under Section 17 rather than through a civil suit.
For a co-operative bank's litigation team, this can be particularly useful when defending against a civil suit filed after possession or auction proceedings have commenced.
6. Practical Application
When a co-operative bank receives a civil suit challenging SARFAESI enforcement, the bank's lawyer should immediately examine:
(a) whether the impugned action is a measure under Section 13(4);
(b) whether the plaintiff is challenging the legality or validity of that SARFAESI measure;
(c) whether the plaintiff qualifies as an "aggrieved person" entitled to approach the DRT under Section 17;
(d) whether Section 34 therefore bars the civil suit;
(e) whether an application under Order VII Rule 11(d) CPC can be made on the ground of statutory bar; and
(f) whether the plaint is attempting to obtain indirectly from the civil court a remedy which the SARFAESI Act assigns to the DRT.
The bank should specifically plead the statutory bar and place the relevant SARFAESI notices, possession documents, auction notice, sale documents and DRT remedy provisions before the civil court.
The practical lesson is that a co-operative bank should not automatically defend every SARFAESI-related civil suit merely on the merits. It should first examine whether the suit itself is maintainable in view of Sections 17 and 34 of the SARFAESI Act.
Summary (Kannada)
Bank of India, M/s Guru Om Automobiles
SARFAESI recovery
• mortgage invalid ಎಂದು declaration;
• property HUF ಆಸ್ತಿ ಎಂದು declaration;
• possession ವಿರುದ್ಧ injunction;
• auction ವಿರುದ್ಧ injunction;
• bank sale ವಿರುದ್ಧ challenge;
(a) ಪ್ರಶ್ನಿಸಲಾದ ಕ್ರಮ Section 13(4) ಅಡಿಯಲ್ಲಿ ಕೈಗೊಂಡ measure ಆಗಿದೆಯೇ;
(b) plaintiff ಆ SARFAESI measure ನ legality ಅಥವಾ validity ಯನ್ನೇ ಪ್ರಶ್ನಿಸುತ್ತಿದ್ದಾನೆಯೇ;
(c) plaintiff Section 17 ಅಡಿಯಲ್ಲಿ DRT ಗೆ ಹೋಗಬಹುದಾದ "aggrieved person" ಆಗಿದ್ದಾನೆಯೇ;
(d) ಹಾಗಿದ್ದರೆ Section 34 civil suit ಅನ್ನು bar ಮಾಡುತ್ತದೆಯೇ;
