Jayant Verma & Ors. v. Union of India & Ors.
- Court: Supreme Court Of India

Key Legal Principles
Section 21A of the Banking Regulation Act, 1949 is constitutionally valid as legislation relating to banking under Entry 45 of List I.
However, its non-obstante effect is not absolute.
Where a valid State Debt Relief Act specifically deals with relief of agricultural indebtedness and covers debts due to banks, Section 21A yields to that State legislation to the extent of the conflict.
The judgment therefore establishes an important distinction between:
• ordinary regulation of banking, which falls within Entry 45 of List I; and
• specific relief of agricultural indebtedness, which falls within Entry 30 of List II.
For co-operative banks, the judgment is also important because it recognises the application of the Banking Regulation Act framework to co-operative banks through Section 56, subject to the statutory modifications and exclusions.
Key Legal Principles (Kannada)
Banking Regulation Act, 1949ರ Section 21A, Constitutionನ Entry 45, List I ಅಡಿಯಲ್ಲಿ bankingಗೆ ಸಂಬಂಧಿಸಿದ valid legislation ಆಗಿದೆ.
ಒಂದು valid State Debt Relief Act agricultural indebtednessಗೆ relief ನೀಡುತ್ತಿದ್ದು ಮತ್ತು banksಗೆ ಬಾಕಿಯಾಗಿರುವ debtsನ್ನೂ ಒಳಗೊಂಡಿದ್ದರೆ, conflict ಇರುವ ಮಟ್ಟಿಗೆ Section 21A ಆ State legislationಗೆ yield ಮಾಡಬೇಕು.
• banking regulation — Entry 45, List I; ಮತ್ತು
• agricultural indebtedness relief — Entry 30, List II
Summary (English)
1. Facts
The petitioners challenged the constitutional validity of Section 21A of the Banking Regulation Act, 1949.
Section 21A provides that a court cannot reopen a transaction between a banking company and its debtor merely on the ground that the rate of interest charged by the bank is excessive.
The challenge was based mainly on the argument that State legislatures have power to provide relief against agricultural indebtedness under Entry 30 of List II of the Seventh Schedule of the Constitution.
The petitioners argued that Section 21A could prevent courts from granting relief to agriculturist borrowers even where State Debt Relief legislation was intended to provide such relief.
The case was particularly significant for banking because the Banking Regulation Act, through Section 56, applies specified provisions to co-operative banks as well.
The Supreme Court therefore also examined the constitutional relationship between Central banking legislation and State legislation concerning agricultural indebtedness.
2. Legal Issue
The principal questions were:
(a) Whether Section 21A of the Banking Regulation Act, 1949 is constitutionally valid;
(b) whether Section 21A falls within Parliament’s legislative power over “banking” under Entry 45 of List I;
(c) whether Section 21A can override State Debt Relief legislation dealing specifically with relief of agricultural indebtedness; and
(d) to what extent Section 21A operates where a State Debt Relief Act also covers debts owed to banks.
3. Court’s Decision
The Supreme Court upheld the constitutional validity of Section 21A.
The Court held that Section 21A is, in pith and substance, part of legislation relating to “banking” under Entry 45 of List I.
However, the Court made an important qualification.
Where a State has enacted valid Debt Relief legislation under the specific constitutional field of “relief of agricultural indebtedness” and that legislation covers debts due to banks, Section 21A must yield to the State legislation to the extent of the conflict.
Therefore, Section 21A is valid generally, but it does not automatically override a State Debt Relief Act that validly provides relief concerning agricultural indebtedness owed to banks.
The Court consequently adopted a harmonised approach rather than treating either Entry 45 of List I or Entry 30 of List II as completely overriding the other.
4. Court’s Reasoning
The Court examined the constitutional distribution of legislative powers.
Entry 45 of List I concerns “banking”, while Entry 30 of List II concerns “relief of agricultural indebtedness”.
The Court held that “banking” must receive a broad interpretation.
A law governing the relationship between a bank and its debtor, including restrictions upon reopening a loan transaction on the ground of excessive interest, can substantially relate to the business of banking.
The Court also noted that the Banking Regulation Act applies, with modifications, to co-operative banks through Part V and Section 56.
Thus, provisions of the Banking Regulation Act concerning banking regulation can operate in relation to co-operative banks where the statutory scheme makes them applicable.
At the same time, the Court recognised that “relief of agricultural indebtedness” is a distinct and specific State legislative field.
The Court therefore applied the principles of pith and substance, incidental encroachment and harmonious construction.
It concluded that Section 21A is valid as banking legislation, but where a State Debt Relief Act directly operates in the special field of agricultural indebtedness and covers bank debts, the State legislation prevails to the extent of the conflict.
5. Relevance to Co-operative Banks
This ruling is useful for co-operative banks particularly in disputes involving agricultural borrowers and claims that the interest charged by the bank is excessive.
Co-operative banks frequently finance agricultural activities. A borrower may rely upon a State Debt Relief statute or agricultural debt-relief provision and seek reopening, reduction or restructuring of the bank’s claim.
The bank may ordinarily rely upon Section 21A where applicable.
However, the lawyer must first check whether the relevant State has a Debt Relief Act that specifically covers agricultural indebtedness and whether that legislation applies to debts owed to the particular bank.
The judgment therefore prevents an overly broad argument on either side.
A bank cannot simply say that Section 21A always defeats every State agricultural debt-relief law.
Conversely, a borrower cannot simply argue that every State law relating to agricultural indebtedness automatically invalidates Section 21A.
The exact State statute and its coverage must be examined.
6. Practical Application
A lawyer representing a co-operative bank can use this judgment when:
(a) an agriculturist borrower asks a civil court to reopen the loan transaction solely on the ground that the interest charged by the bank is excessive;
(b) a borrower invokes a State Debt Relief Act against the bank’s claim;
(c) a borrower argues that Section 21A is constitutionally invalid;
(d) the bank needs to establish that banking regulation, including regulation of loan transactions, falls within Parliament’s legislative field; or
(e) there is a conflict between Section 21A and a State agricultural debt-relief statute.
The lawyer should first identify:
1. the exact State Debt Relief statute;
2. whether it applies to agricultural indebtedness;
3. whether it covers debts owed to banks;
4. whether the particular co-operative bank falls within the statutory definition of “bank”; and
5. whether there is an actual conflict between the State provision and Section 21A.
The practical lesson is that Section 21A is a strong statutory protection for banking transactions against reopening merely on the ground of excessive interest, but that protection is subject to the constitutionally recognised field of State legislation concerning relief of agricultural indebtedness.
Summary (Kannada)
Petitionersನ ಮುಖ್ಯ ವಾದವೆಂದರೆ Constitutionನ Seventh Scheduleನ List II, Entry 30 ಅಡಿಯಲ್ಲಿ State Legislatureಗೆ agricultural indebtednessನಿಂದ relief ನೀಡುವ ಅಧಿಕಾರವಿದೆ.
State Debt Relief legislation
ಆದ್ದರಿಂದ Supreme Court Central banking legislation ಮತ್ತು agricultural indebtednessಗೆ ಸಂಬಂಧಿಸಿದ State legislationಗಳ ನಡುವಿನ constitutional relationship ಅನ್ನು ಪರಿಶೀಲಿಸಿತು.
(a) Banking Regulation Act, 1949ರ Section 21A constitutional ಆಗಿದೆಯೇ?
(b) Section 21A Parliamentನ Entry 45, List I ಅಡಿಯಲ್ಲಿ ಇರುವ “banking” legislative powerಗೆ ಒಳಪಡುತ್ತದೆಯೇ?
(c) Agricultural indebtednessಗೆ ಸಂಬಂಧಿಸಿದ State Debt Relief legislation ಮೇಲೆ Section 21A ಮೇಲುಗೈ ಸಾಧಿಸುತ್ತದೆಯೇ?
(d) State Debt Relief Act
Supreme Court Section 21Aನ constitutional validityಯನ್ನು upheld ಮಾಡಿತು.
Section 21A, ಅದರ pith and substanceನಲ್ಲಿ, Constitutionನ Entry 45, List I ಅಡಿಯಲ್ಲಿ ಬರುವ “banking” ವಿಷಯಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಕಾನೂನು ಎಂದು Court ತೀರ್ಮಾನಿಸಿತು.
ಒಂದು Stateನಲ್ಲಿ valid Debt Relief legislation ಇದ್ದು, ಅದು “relief of agricultural indebtedness” ಎಂಬ State legislative field ಅಡಿಯಲ್ಲಿ agricultural debtsಗೆ relief ನೀಡುತ್ತಿದ್ದರೆ ಮತ್ತು ಆ ಕಾಯ್ದೆ banksಗೆ ಬಾಕಿಯಾಗಿರುವ debtsನ್ನೂ ಒಳಗೊಂಡಿದ್ದರೆ, conflict ಇರುವ ಮಟ್ಟಿಗೆ Section 21A ಆ State legislationಗೆ yield ಮಾಡಬೇಕು ಎಂದು Court ಹೇಳಿತು.
ಅಂದರೆ Section 21A ಸಾಮಾನ್ಯವಾಗಿ valid ಆಗಿದ್ದರೂ, agricultural indebtednessಗೆ ಸಂಬಂಧಿಸಿದ State Debt Relief Act ಅನ್ನು ಪ್ರತಿಯೊಂದು ಸಂದರ್ಭದಲ್ಲೂ automatically override ಮಾಡುವುದಿಲ್ಲ.
Court constitutional legislative powersನ distribution ಅನ್ನು ಪರಿಶೀಲಿಸಿತು.
List I, Entry 45 “banking”
List II, Entry 30 “relief of agricultural indebtedness”
ಆದರೆ “relief of agricultural indebtedness” ಒಂದು ಪ್ರತ್ಯೇಕ ಮತ್ತು ನಿರ್ದಿಷ್ಟ State legislative field ಎಂದು Court ಒಪ್ಪಿಕೊಂಡಿತು.
ಆದ್ದರಿಂದ Court pith and substance, incidental encroachment ಮತ್ತು harmonious construction ಎಂಬ ತತ್ವಗಳನ್ನು ಅನ್ವಯಿಸಿತು.
ಆದರೆ State Debt Relief Act ನಿರ್ದಿಷ್ಟವಾಗಿ agricultural indebtednessಗೆ relief ನೀಡುತ್ತಿದ್ದು, bank debtsನ್ನೂ ಒಳಗೊಂಡಿದ್ದರೆ, conflict ಇರುವ ಮಟ್ಟಿಗೆ State legislationಗೆ ಆದ್ಯತೆ ಇರುತ್ತದೆ.
ಅಥವಾ State Debt Relief Act ಅನ್ನು ಆಧರಿಸಿ bankನ recovery claim ವಿರುದ್ಧ relief ಕೇಳಬಹುದು.
(a) agriculturist borrower interest excessive ಎಂದು ಹೇಳಿ civil courtನಲ್ಲಿ loan transaction reopen ಮಾಡಲು ಪ್ರಯತ್ನಿಸಿದಾಗ;
(b) borrower State Debt Relief Act ಅನ್ನು bankನ recovery ವಿರುದ್ಧ ಬಳಸಿದಾಗ;
(c) borrower Section 21A constitutional ಅಲ್ಲ ಎಂದು ವಾದಿಸಿದಾಗ;
(e) Section 21A ಮತ್ತು State agricultural debt-relief provision ನಡುವೆ conflict ಇದ್ದಾಗ.
1. ಸಂಬಂಧಿತ State Debt Relief Act ಯಾವುದು;
2. ಅದು agricultural indebtednessಗೆ ಅನ್ವಯಿಸುತ್ತದೆಯೇ;
3. ಅದು banksಗೆ ಬಾಕಿಯಾಗಿರುವ debtsನ್ನೂ ಒಳಗೊಂಡಿದೆಯೇ;
