Kerala State Co-operative Agricultural and Rural Development Bank Ltd. (KSCARDB) v. The Assessing Officer, Trivandrum & Ors.
- Court: Supreme Court Of India
- Year: 2023
- Neutral citation: 2023 INSC 830
Key Legal Principles
The important principle is:
For Section 80P(4) of the Income Tax Act, the expression "co-operative bank" must be understood with reference to the meaning assigned under the Banking Regulation Act.
A co-operative society does not become a co-operative bank merely because its name or State legislation describes it as a bank.
The relevant questions include:
(a) whether the entity falls within the statutory categories of State/Central/Primary Co-operative Bank;
(b) whether it actually carries on "banking business" as defined in Section 5(b) of the Banking Regulation Act; and
(c) whether the statutory framework governing it requires it to possess the characteristics of a co-operative bank.
Key Legal Principles (Kannada)
(a) ಸಂಸ್ಥೆ State/Central/Primary Co-operative Bank ಎಂಬ statutory categoryಗೆ ಸೇರುತ್ತದೆಯೇ;
Summary (English)
1. Facts
The appellant, Kerala State Co-operative Agricultural and Rural Development Bank Ltd. (KSCARDB), was a State-level agricultural and rural development bank functioning as a co-operative society.
It provided credit facilities to its members, which were themselves co-operative societies.
For Assessment Year 2007–08, the Bank claimed deduction under Section 80P(2)(a)(i) of the Income Tax Act for profits attributable to providing credit facilities to its members.
The Income Tax Department rejected the claim on the ground that KSCARDB was a "co-operative bank" and therefore excluded from Section 80P by virtue of Section 80P(4).
The Kerala High Court and Income Tax Appellate Tribunal had substantially upheld the Revenue's position.
The matter therefore reached the Supreme Court.
2. Legal Issue
Whether a State-level Agricultural and Rural Development Bank constituted as a co-operative society, which does not carry on "banking business" as defined under Section 5(b) of the Banking Regulation Act, 1949, is a "co-operative bank" for the purposes of Section 80P(4) of the Income Tax Act.
Consequently, whether such an institution is entitled to deduction under Section 80P(2)(a)(i).
3. Court's Decision
The Supreme Court allowed the appeals.
It held that KSCARDB was not a "co-operative bank" within the meaning of Section 5(b) read with Section 56 of the Banking Regulation Act, 1949.
Consequently, Section 80P(4) did not exclude the appellant from claiming the deduction under Section 80P(2)(a)(i).
The Court therefore set aside the contrary orders and allowed the appellant's claim in accordance with law.
4. Court's Reasoning
The Supreme Court examined the statutory definitions in the Banking Regulation Act and NABARD Act.
Section 80P(4) excludes "co-operative banks" from the benefit of Section 80P, except the specified categories of primary agricultural credit societies and primary co-operative agricultural and rural development banks.
For determining whether an institution is a co-operative bank, the Court referred to Part V of the Banking Regulation Act.
The Court emphasised that "banking" has a specific statutory meaning under Section 5(b) of the Banking Regulation Act, namely accepting deposits from the public for the purpose of lending or investment, with the prescribed withdrawal mechanism.
The Court also examined the NABARD Act definitions of State Co-operative Bank and Central Co-operative Bank.
It held that nomenclature alone is not decisive. The actual statutory character and activities of the institution must be examined.
A co-operative society which does not transact banking business as defined in Section 5(b) of the Banking Regulation Act cannot simply be treated as a co-operative bank merely because it is described as a bank under a State enactment.
5. Relevance to Co-operative Banks
This is an important Supreme Court authority for understanding the legal distinction between:
• a co-operative society;
• a co-operative credit society;
• an agricultural/rural development bank; and
• a co-operative bank governed by Part V of the Banking Regulation Act.
This distinction has consequences not merely under income-tax law but also for determining which regulatory and statutory provisions apply to a particular co-operative institution.
For lawyers advising co-operative banks or co-operative credit institutions, the case is particularly useful when an authority attempts to determine the legal status of an institution merely from its nomenclature.
6. Practical Application
When advising a co-operative institution, its legal department should examine:
• the statute under which it is registered;
• its bye-laws;
• its principal objects;
• its actual activities;
• whether it accepts deposits from the public;
• whether it carries on banking business within Section 5(b) of the Banking Regulation Act;
• whether it falls within the statutory definition of a State, Central or Primary Co-operative Bank; and
• whether it possesses or requires an RBI banking licence.
The case is particularly useful in tax proceedings involving Section 80P, but its reasoning concerning the statutory meaning of "co-operative bank" can also assist in analysing the regulatory character of a co-operative institution.
A caution is necessary: this judgment does not mean that every co-operative society providing credit facilities automatically receives Section 80P benefits. Eligibility depends upon the statutory requirements and the actual nature of the institution and its activities.
Summary (Kannada)
Kerala State Co-operative Agricultural and Rural Development Bank Ltd. (KSCARDB) ಒಂದು State-level Agricultural and Rural Development Bank ಆಗಿದ್ದು, co-operative society ಆಗಿ ಕಾರ್ಯನಿರ್ವಹಿಸುತ್ತಿತ್ತು.
Assessment Year 2007–08ಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ, ತನ್ನ ಸದಸ್ಯರಿಗೆ credit facilities ಒದಗಿಸುವುದರಿಂದ ಬಂದ profits ಮೇಲೆ Income Tax Actನ Section 80P(2)(a)(i) ಅಡಿಯಲ್ಲಿ deduction ಅನ್ನು ಬ್ಯಾಂಕ್ ಕೇಳಿತ್ತು.
Banking Regulation Act, 1949ರ Section 5(b)ನಲ್ಲಿ ವ್ಯಾಖ್ಯಾನಿಸಿರುವ "banking business" ಅನ್ನು ನಡೆಸದ State-level Agricultural and Rural Development Bank ಅನ್ನು Income Tax Actನ Section 80P(4) ಉದ್ದೇಶಕ್ಕಾಗಿ "co-operative bank" ಎಂದು ಪರಿಗಣಿಸಬಹುದೇ?
ಅಂತಹ ಸಂಸ್ಥೆಗೆ Section 80P(2)(a)(i) ಅಡಿಯಲ್ಲಿ deduction ಸಿಗಬಹುದೇ?
NABARD Actನ State Co-operative Bank ಮತ್ತು Central Co-operative Bankಗಳ definitionsನ್ನೂ Court ಪರಿಶೀಲಿಸಿತು.
• co-operative society;
• co-operative credit society;
• agricultural/rural development bank; ಮತ್ತು
• ಸಂಸ್ಥೆ ಯಾವ statute ಅಡಿಯಲ್ಲಿ registered ಆಗಿದೆ;
• ಅದರ bye-laws;
• ಅದರ principal objects;
• ಅದು ನಿಜವಾಗಿ ನಡೆಸುವ activities;
• publicನಿಂದ deposits ಸ್ವೀಕರಿಸುತ್ತದೆಯೇ;
• Banking Regulation Actನ Section 5(b) ಅಡಿಯಲ್ಲಿ banking business ನಡೆಸುತ್ತದೆಯೇ;
• State, Central ಅಥವಾ Primary Co-operative Bankನ statutory definitionಗೆ ಸೇರುತ್ತದೆಯೇ; ಮತ್ತು
