M/s. Mandvi Co-op Bank Ltd. v. Nimesh B. Thakore
- Court: Supreme Court Of India
- Year: 2010
- Neutral citation: 2010 INSC 27
Key Legal Principles
The Supreme Court established the following important principles:
• Under Section 145(2), the accused has an absolute right to have the complainant or his witness summoned when an application is made.
• The witness need not repeat the examination-in-chief orally because the affidavit already constitutes the evidence-in-chief.
• The accused can cross-examine the complainant or witness on the affidavit evidence.
• Section 145(1) expressly permits the complainant to give evidence by affidavit.
• The accused cannot claim an identical statutory right merely by analogy.
• Courts cannot rewrite or add words to clear statutory provisions under the guise of interpretation.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
M/s. Mandvi Co-op Bank Ltd. was the complainant in proceedings arising from dishonour of cheques under Section 138 of the Negotiable Instruments Act, 1881.
The case arose after the 2002 amendments to the Negotiable Instruments Act introduced Sections 143 to 147, particularly Section 145, which permits the complainant to give evidence by affidavit.
The Gujarat High Court had issued several procedural directions concerning cheque-dishonour trials.
One of the questions before the Supreme Court was whether, when an accused invokes Section 145(2) and asks the Court to summon a complainant or witness whose evidence has already been given by affidavit, that witness must again give examination-in-chief orally before being cross-examined.
Another question concerned whether the accused could himself give evidence by affidavit in the same manner as the complainant under Section 145(1).
2. Legal Issue
The principal issues were:
(a) When the accused applies under Section 145(2) of the Negotiable Instruments Act, is the Court bound to summon the complainant or witness whose evidence has been filed by affidavit?
(b) Once summoned, must that witness repeat the entire examination-in-chief orally before cross-examination?
(c) Can an accused claim the same statutory right as the complainant to give evidence by affidavit under Section 145(1)?
3. Court's Decision
The Supreme Court held that when the accused makes an application under Section 145(2), the Court is required to summon the person who has given evidence on affidavit.
However, the Court held that the summoned complainant or witness need not repeat the entire examination-in-chief orally.
The affidavit already on record constitutes the evidence-in-chief. The accused is entitled to cross-examine the deponent regarding the facts stated in the affidavit.
The Supreme Court also held that the accused does NOT have an equivalent statutory right under Section 145(1) to give evidence by affidavit.
The Court set aside the High Court's direction which permitted the accused to give evidence by affidavit by analogy with the complainant.
4. Court's Reasoning
The Supreme Court examined the special procedure introduced by Sections 143 to 147 of the Negotiable Instruments Act.
The purpose of these provisions was to make cheque-dishonour trials faster and simpler.
Section 145(1) specifically permits the complainant to give evidence by affidavit.
Section 145(2) provides that the Court may summon and examine the person giving evidence on affidavit and that it shall do so when the prosecution or accused makes an application.
The Court held that the word "examine" in Section 145(2) does not require the witness to start the entire evidence again with examination-in-chief.
The affidavit itself is already in the nature of examination-in-chief.
Therefore, when the accused applies under Section 145(2), the complainant or witness must be summoned, but the accused can proceed directly to cross-examination on the affidavit evidence.
The Court observed that requiring the complainant to repeat the entire examination-in-chief would create unnecessary duplication and defeat the legislative purpose of speedy disposal.
Regarding defence evidence, the Court held that Section 145(1) expressly grants the right to give evidence by affidavit to the complainant and does not grant the same right to the accused.
The Court held that a court cannot add words to a statute merely because it considers that the legislature should have included them.
5. Relevance to Co-operative Banks
This judgment is directly relevant to co-operative banks because co-operative banks frequently initiate proceedings under Section 138 of the Negotiable Instruments Act for dishonoured cheques issued towards repayment of loans, instalments, interest or other banking liabilities.
The judgment is particularly useful for a co-operative bank's legal department or advocate when conducting cheque-bounce prosecutions.
It clarifies that:
• the bank's authorised representative can give evidence by affidavit;
• the accused cannot insist that the bank's representative repeat the entire examination-in-chief orally merely because the witness has been summoned under Section 145(2);
• the accused nevertheless retains the right to cross-examine the bank's witness;
• the procedure is intended to avoid unnecessary delay in cheque-dishonour proceedings.
6. Practical Application
When a co-operative bank files a Section 138 complaint, its advocate can rely upon this judgment while dealing with applications under Section 145(2).
For example:
If the bank's authorised representative has filed evidence by affidavit and the accused applies under Section 145(2), the Court must summon the representative.
However, once the representative appears, the affidavit already filed constitutes the examination-in-chief. The accused is entitled to cross-examine the representative, but cannot insist that the entire examination-in-chief be repeated orally.
This is particularly useful where bank officials are required to attend numerous cheque-bounce cases.
The judgment also prevents the accused from automatically claiming the complainant's statutory facility of affidavit evidence.
For co-operative-bank litigation, the practical principle is:
Section 145 creates a streamlined evidentiary procedure for cheque-dishonour cases. The bank's evidence can be filed by affidavit, the accused has the right to summon the bank's witness for cross-examination, but the witness need not repeat the affidavit orally as examination-in-chief.
Summary (Kannada)
• ಬ್ಯಾಂಕಿನ authorised representative affidavit ಮೂಲಕ evidence ಸಲ್ಲಿಸಬಹುದು;
• Section 145(2) ಅಡಿಯಲ್ಲಿ witness summon ಆದ ಕಾರಣಕ್ಕೆ ಮಾತ್ರ ಬ್ಯಾಂಕಿನ representative ಸಂಪೂರ್ಣ examination-in-chief ಅನ್ನು ಮತ್ತೆ ಮೌಖಿಕವಾಗಿ ಹೇಳಬೇಕೆಂದು accused ಒತ್ತಾಯಿಸಲು ಸಾಧ್ಯವಿಲ್ಲ;
• ಆದರೆ accused ಗೆ ಬ್ಯಾಂಕಿನ witness ಅನ್ನು cross-examine ಮಾಡುವ ಹಕ್ಕು ಇರುತ್ತದೆ;
