Narayan Chandra Ghosh v. UCO Bank & Ors.
- Court: Supreme Court Of India
- Year: 2011
- Neutral citation: 2011 INSC 222
Key Legal Principles
The right of appeal under Section 18 of the SARFAESI Act is subject to the statutory pre-deposit requirement.
The DRAT cannot completely waive the pre-deposit.
Where the DRT has not determined the debt, the amount claimed by the secured creditor is relevant for calculating the pre-deposit.
The statutory discretion of the DRAT permits reduction of the deposit but not complete waiver.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
The borrower had challenged proceedings before the Debts Recovery Tribunal (DRT). The DRT had not determined the exact amount of debt due.
The borrower thereafter sought to appeal before the Debts Recovery Appellate Tribunal (DRAT) under Section 18 of the SARFAESI Act.
The DRAT permitted the appeal without insisting upon the statutory pre-deposit. The High Court set aside that order.
The borrower approached the Supreme Court, contending that since the DRT had not determined the amount due, no pre-deposit should be required.
2. Legal Issue
Whether the DRAT has jurisdiction to completely waive the pre-deposit required under the second proviso to Section 18(1) of the SARFAESI Act when a borrower files an appeal against an order of the DRT.
3. Court's Decision
The Supreme Court held that the pre-deposit requirement under Section 18(1) is mandatory.
The DRAT has no power to completely waive the statutory pre-deposit.
Under the then applicable provision, the borrower was required to deposit 50% of the debt due, calculated with reference to the amount claimed by the secured creditor or determined by the DRT, whichever was less.
The DRAT could reduce this amount, for reasons recorded in writing, but could not reduce it below 25%.
Since the DRT had not determined the debt, the Court directed the borrower to deposit Rs.15 lakh and permitted the appeal to be heard on merits.
4. Court's Reasoning
Section 18 confers a statutory right of appeal, but that right is expressly subject to the condition of pre-deposit.
The Supreme Court held that the language of Section 18 was clear: an appeal could not be entertained unless the statutory deposit requirement was fulfilled.
The fact that the DRT had not yet determined the amount of debt did not eliminate the requirement. In such a situation, the amount claimed by the secured creditor could be used for calculating the statutory deposit.
The Court further held that the power given to the DRAT was only to reduce the deposit, for reasons recorded in writing, to not less than 25%. It did not include a power to completely dispense with the deposit.
5. Relevance to Co-operative Banks
This is a highly useful recovery-law precedent for a co-operative bank because it strengthens the bank's position when a borrower challenges a DRT order before the DRAT without complying with the statutory pre-deposit requirement.
The judgment is particularly useful when:
• the borrower argues that the DRT has not determined the exact debt;
• the borrower seeks complete exemption from pre-deposit;
• the borrower claims that the DRAT has unrestricted discretion to waive the deposit; or
• the bank needs to oppose an appeal being entertained without compliance with Section 18.
6. Practical Application
When opposing a borrower's Section 18 appeal, the bank can rely on this judgment to submit that compliance with the statutory pre-deposit requirement is a condition precedent to entertainment of the appeal.
The bank should distinguish between:
(a) complete waiver — impermissible; and
(b) statutory reduction — permissible only within the limits prescribed by Section 18.
Important current-law point:
This judgment interpreted the version of Section 18 applicable in 2011. The statutory percentage and procedural position must always be checked against the law applicable on the date of the particular appeal. The core principle that the statutory pre-deposit is a condition governing the Section 18 appeal remains important, but the exact percentage should not be mechanically taken from this 2011 judgment.
Summary (Kannada)
• DRT ಸಾಲದ ನಿಖರ ಮೊತ್ತವನ್ನು ನಿರ್ಧರಿಸಿಲ್ಲ ಎಂದು ಸಾಲಗಾರ ವಾದಿಸಿದಾಗ;
• pre-deposit ಸಂಪೂರ್ಣವಾಗಿ waive ಮಾಡುವಂತೆ ಸಾಲಗಾರ ಕೇಳಿದಾಗ;
