Sheela Gehlot v. Mohini Hardayal Singh & Ors.

  • Court: Supreme Court Of India
  • Year: 2026
  • Neutral citation: 2026 INSC 863

Key Legal Principles

1. Mere technical non-service of notice is not necessarily fatal to an auction sale.

2. Actual knowledge of the proceedings by the affected party is relevant

3. The challenger must demonstrate substantial prejudice/injury.

4. Participation in the recovery proceedings and filing of objections may establish actual knowledge.

5. Failure to avail the appropriate statutory remedy against the sale may also be relevant.

6. A residential-property exemption available to the judgment-debtor cannot automatically be claimed by his legal representatives.

Summary (English)

FACTS

Sterling Malt & Foods Pvt. Ltd. had availed credit facilities from Punjab & Sind Bank. The loan was secured by the company’s factory property, while personal guarantees were furnished by its Directors.

After default, recovery proceedings were initiated. During the execution/recovery proceedings before the DRT, a Delhi residential property belonging to the judgment-debtor’s family was ordered to be auctioned.

The judgment-debtor had died, and his legal representatives, including his wife Mohini Hardayal Singh, were brought on record.

The legal representatives subsequently challenged the auction, principally contending that they had not been served with the required notice under Order XXI Rule 22 CPC and the Second Schedule to the Income-tax Act, 1961.

ISSUES BEFORE THE SUPREME COURT

1. Whether non-service of notice under Order XXI Rule 22 CPC invalidated the auction sale.

2. Whether failure to serve notice under Rule 2 of the Second Schedule to the Income-tax Act, 1961 rendered the execution proceedings or auction sale void.

3. Whether the Delhi residential property was protected from attachment and sale under Section 60(1)(ccc) CPC.

SUPREME COURT’S FINDINGS

1. NON-SERVICE OF NOTICE DOES NOT AUTOMATICALLY INVALIDATE THE SALE

The Supreme Court held that the mere absence of notice under Order XXI Rule 22 CPC does not automatically make an auction sale void.

The Court examined the actual circumstances and found that the legal representatives already had knowledge of the execution proceedings and the proposed auction. They had participated in the proceedings and had filed objections concerning the property.

Therefore, there was no substantial prejudice caused to them by the non-service of the formal notice.

The Court consequently declined to invalidate the auction sale merely on the ground of non-service of notice.

2. ACTUAL KNOWLEDGE AND ABSENCE OF PREJUDICE ARE MATERIAL

The Court placed importance on the fact that the legal representatives were already aware of the proceedings and had actually participated in them.

The wife had filed applications before the DRT concerning the property and had challenged the order directing the auction.

Thus, the Court held that the absence of formal notice did not result in substantial injury or prejudice in the facts of the case.

The Court also noted that, after the sale, the legal representatives had not availed themselves of the remedy available under Rule 61 of the Second Schedule.

3. RESIDENTIAL PROPERTY PROTECTION UNDER SECTION 60(1)(ccc) CPC

The Court held that the exemption available under Section 60(1)(ccc) CPC is a protection available to the judgment-debtor.

The protection does not automatically extend to the legal representatives of the judgment-debtor after his death.

Therefore, the legal representatives could not claim the benefit of the exemption merely because the property constituted their residence.

4. IMPORTANCE OF RAISING OBJECTIONS AT THE APPROPRIATE STAGE

The Supreme Court also observed that a mixed question of law and fact cannot ordinarily be raised for the first time in writ proceedings when the relevant factual foundation was not properly established before the appropriate forum.

FINAL DECISION

The Supreme Court:

• Set aside the judgment of the Madhya Pradesh High Court.

• Allowed Civil Appeal Nos. 182 and 190 of 2016 filed by the auction-purchaser and Punjab & Sind Bank.

• Dismissed Civil Appeal No. 191 of 2016.

• Consequently upheld the auction sale in the facts of the case.

KEY LEGAL PRINCIPLE

Non-service of a notice required during execution/recovery proceedings does not, by itself, automatically render an auction sale void. The Court will consider whether the affected party had actual knowledge of the proceedings and whether substantial prejudice or injury was actually caused.

Further, the protection of a judgment-debtor’s residential property under Section 60(1)(ccc) CPC is personal to the judgment-debtor and does not automatically pass to his legal representatives.

Summary (Kannada)

Sterling Malt & Foods Pvt.

4. Actual Knowledge

5. Residential Property

DRT / BANK RECOVERY CASES
