Sree Anandhakumar Mills Ltd. v. Indian Overseas Bank & Ors.

  • Court: Supreme Court Of India
  • Year: 2018
  • Neutral citation: 2018 INSC 432

Key Legal Principles

The important principles are:

(i) A civil court cannot ordinarily entertain a suit where the substance of the grievance concerns measures taken under Section 13(4) of SARFAESI.

(ii) Section 17 provides an efficacious remedy before the DRT to persons aggrieved by SARFAESI measures.

(iii) Merely describing a proceeding as a "partition suit" does not necessarily take it outside the bar created by Section 34.

(iv) The SARFAESI Act overrides inconsistent legal provisions by virtue of Section 35.

(v) A third party claiming an interest in secured property must ordinarily approach the DRT when the grievance relates to a SARFAESI measure.

Key Legal Principles (Kannada)

Summary (English)

1. Facts

Sree Anandhakumar Mills Ltd. was involved in proceedings concerning secured property over which Indian Overseas Bank had initiated SARFAESI proceedings.

During the SARFAESI proceedings, Nandini, a third party, instituted a civil suit seeking partition of the property and obtained an injunction.

The Madras High Court held that because the suit was one for partition, Section 34 of the SARFAESI Act did not bar the civil suit and upheld the injunction.

The auction purchaser challenged this position before the Supreme Court.

2. Legal Issue

Whether a civil suit for partition concerning property against which SARFAESI proceedings have been initiated is maintainable before a civil court, or whether the aggrieved person must approach the DRT under Section 17 of the SARFAESI Act.

3. Court's Decision

The Supreme Court allowed the appeals and set aside the High Court's order.

The Court held that the civil suit was not maintainable in the circumstances because the grievance related to measures taken under the SARFAESI Act.

The Court relied upon its earlier decision in Jagdish Singh v. Heeralal and held that an aggrieved person must pursue the remedy available under Section 17 of the SARFAESI Act before the DRT.

The auction sale in favour of the appellant was maintained.

The Court nevertheless permitted the concerned respondent to approach the DRT and directed that the DRT should consider the issues available to the parties on their merits.

4. Court's Reasoning

The Supreme Court noted that the central question was the maintainability of the civil suit.

The Court relied directly upon the principle laid down in Jagdish Singh v. Heeralal, where it had considered Sections 2(zf), 2(zc), 13(1), 17, 18 and 34 of the SARFAESI Act.

Where a grievance concerns measures taken under Section 13(4), Section 17 provides an efficacious statutory remedy before the DRT.

Section 34 bars a civil court from entertaining suits or proceedings in respect of matters which the DRT is empowered to determine under the SARFAESI Act.

The fact that the suit was framed as a partition suit did not by itself remove the statutory bar when the substance of the dispute concerned SARFAESI measures affecting the secured property.

The Supreme Court therefore set aside the High Court's view and directed the aggrieved party to pursue the DRT remedy.

5. Relevance to Co-operative Banks

This is practically important for co-operative banks because borrowers and third parties sometimes institute civil suits concerning mortgaged property after SARFAESI proceedings have commenced.

A plaintiff may frame the dispute as:

• partition;

• declaration of title;

• injunction;

• possession; or

• another civil claim concerning the secured property.

The bank can examine whether the real substance of the suit is an attempt to challenge or obstruct a SARFAESI measure.

If so, Section 34 and the Section 17 DRT remedy become important objections to civil-court jurisdiction.

6. Practical Application

When a civil suit is filed against a co-operative bank during SARFAESI enforcement, the bank's lawyer should examine the substance of the relief rather than merely the title of the suit.

The following questions should be checked:

1. Has a SARFAESI measure under Section 13(4) already been taken?

2. Does the plaintiff's alleged right directly affect the secured asset?

3. Is the relief sought effectively intended to invalidate, restrain or interfere with the SARFAESI measure?

4. Does Section 17 provide a remedy for the grievance?

5. Does the civil court have any independent issue that falls outside the DRT's jurisdiction?

Where the substance of the dispute falls within Section 17, the bank can rely upon Section 34 and this judgment to challenge maintainability of the civil suit.

Important limitation:

This judgment does not mean that every civil suit involving a secured property is automatically barred. The nature of the claim and the relief sought must be examined. Section 34 bars civil-court jurisdiction in matters that fall within the statutory field assigned to the DRT, subject to the recognised exceptions in SARFAESI jurisprudence.

Summary (Kannada)

Jagdish Singh v.

Civil suit maintainability

Jagdish Singh v.

Plaintiff suit

• partition;

• declaration of title;

• injunction;
