Aslam Pasha v. The Town Co-operative Bank Ltd. & Anr.
- Court: Karnataka High Court
- Year: 2026
- Neutral citation: 2026:KHC:28258
Key Legal Principles
Where the Karnataka Co-operative Societies Act provides an efficacious statutory appellate remedy against co-operative recovery proceedings, the High Court may decline to exercise its writ jurisdiction under Articles 226 and 227.
A borrower challenging a recovery order or auction should ordinarily pursue the statutory remedy before approaching the High Court, unless circumstances exist that justify exercise of writ jurisdiction despite the alternative remedy.
Where a litigant has bona fide pursued a writ proceeding before being directed to the statutory remedy, Section 14 of the Limitation Act may protect the period spent prosecuting the proceeding in accordance with its requirements.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
The petitioner had availed a loan from the Town Co-operative Bank Ltd.
Due to default in repayment, recovery proceedings were initiated against the petitioner. In those proceedings, an award was passed and subsequently recovery proceedings were taken forward through the co-operative recovery machinery.
A public auction of the petitioner's properties was scheduled pursuant to a notice issued under Rule 38(2)(d) of the Karnataka Co-operative Societies Rules.
The petitioner approached the Karnataka High Court under Articles 226 and 227 seeking, among other reliefs, stay and setting aside of the auction proceedings.
The petitioner also sought a direction to the bank to examine the loan account, take into account payments allegedly made by his father, recalculate the outstanding amount and furnish a proper statement of account.
2. Legal Issue
The principal issue was:
Whether a borrower can directly invoke the writ jurisdiction of the High Court to challenge recovery and proposed auction proceedings initiated by a co-operative bank when an efficacious statutory appellate remedy is available under Sections 105 and 106 of the Karnataka Co-operative Societies Act.
3. Court's Decision
The High Court dismissed the writ petition.
The Court held that the petitioner had an alternative and efficacious remedy under Sections 105 and 106 of the Karnataka Co-operative Societies Act, 1959.
Accordingly, the petitioner was granted liberty to approach the competent appellate authority in accordance with law.
The Court also held that, if the petitioner pursued the statutory remedy, he would be entitled to claim the benefit of Section 14 of the Limitation Act, 1963 for the period spent bona fide pursuing the writ proceedings.
The Court directed that the respondents should not precipitate the matter against the petitioner for four weeks from the date of the order.
4. Court's Reasoning
The Court noted that the dispute arose from recovery proceedings initiated by the co-operative bank against the borrower.
The Karnataka Co-operative Societies Act itself provides a statutory mechanism for challenging orders and recovery proceedings, including an appellate remedy under Sections 105 and 106.
Since such an alternative and efficacious remedy was available, the Court declined to exercise its extraordinary writ jurisdiction.
The Court therefore did not examine the merits of the petitioner's allegations regarding the loan account, alleged payments by his father, calculation of outstanding dues or validity of the recovery proceedings.
Importantly, the Court preserved the petitioner's right to approach the statutory appellate authority and clarified that the authority should decide the matter independently without being influenced by the High Court's observations.
5. Relevance to Co-operative Banks
This judgment is directly useful to co-operative banks in Karnataka when borrowers approach the High Court challenging recovery proceedings, auction notices or recovery awards without first exhausting the remedies under the Karnataka Co-operative Societies Act.
It provides a preliminary jurisdictional objection based on availability of an alternative statutory remedy.
It is particularly relevant to:
• recovery awards against borrowers;
• execution of co-operative recovery awards;
• auction of borrowers' properties;
• Rule 38(2)(d) auction notices;
• challenges to calculation of outstanding dues;
• disputes concerning alleged payments or adjustments; and
• writ petitions filed directly against co-operative recovery machinery.
6. Practical Application
When a borrower files a writ petition against a co-operative bank challenging recovery or auction proceedings, the bank should examine:
1. Whether the impugned action arises from proceedings under the Karnataka Co-operative Societies Act.
2. Whether Sections 105 and 106 provide an applicable appellate or statutory remedy.
3. Whether the petitioner has already participated in or challenged the underlying recovery proceedings before the competent co-operative authority.
4. Whether the petition merely raises disputed factual issues concerning payments, accounts, calculation of dues or the recovery process.
5. Whether there are exceptional circumstances warranting exercise of writ jurisdiction despite the alternative remedy.
6. Whether any interim protection is required for a limited period to enable the borrower to approach the statutory appellate authority.
For a co-operative bank, the judgment can therefore be relied upon to request dismissal of a premature writ petition and insist that the borrower first pursue the statutory appellate mechanism under the Karnataka Co-operative Societies Act.
