Smt. Sudha S. v. The Bangalore City Co-operative Bank Ltd. & Ors.
- Court: Karnataka High Court
- Year: 2026
- Neutral citation: 2026:KHC:3615-DB
Key Legal Principles
An order passed under Section 14 of the SARFAESI Act for taking possession of secured assets is a measure in furtherance of Section 13(4).
A person aggrieved by such possession/enforcement measures can invoke the remedy under Section 17 before the DRT.
The DRT's jurisdiction under Section 17 is not merely investigative; it extends to examining the legality of SARFAESI measures and granting appropriate relief.
The existence of Article 227 jurisdiction does not ordinarily justify bypassing the statutory DRT remedy where that remedy is available.
This is particularly important where the borrower has already approached the DRT concerning the same SARFAESI enforcement proceedings.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
The appellant had availed term loans of approximately ₹2.43 crore from The Bangalore City Co-operative Bank Ltd. The loan account was subsequently classified as an NPA.
The Bank issued a demand notice under Section 13(2) of the SARFAESI Act and thereafter proceeded under Section 13(4).
The Bank then approached the Additional Chief Metropolitan Magistrate, Bengaluru under Section 14 of the SARFAESI Act for taking physical possession of the secured assets.
The borrower had previously approached the Karnataka High Court and thereafter the Debts Recovery Tribunal (DRT). The DRT passed an interim order directing maintenance of status quo subject to the borrower depositing 25% of the outstanding amount in two instalments. The borrower did not comply with that condition.
The Bank subsequently obtained another order under Section 14 for taking possession of the secured assets.
The borrower again approached the High Court under Articles 226/227, contending, among other things, that an order under Section 14 could be challenged before the High Court because there was allegedly no adequate remedy before the DRT.
2. Legal Issue
Whether a borrower can invoke the writ/supervisory jurisdiction of the High Court under Articles 226/227 to challenge measures taken under Section 14 of the SARFAESI Act when the borrower has a statutory remedy before the DRT under Section 17.
A connected contention was whether the jurisdiction of the DRT under Section 17 is confined merely to an "investigation" and does not extend to examining enforcement measures connected with Section 14.
3. Court's Decision
The High Court dismissed the writ appeal.
It held that an order under Section 14 is in furtherance of the measures taken under Section 13(4) of the SARFAESI Act.
Therefore, an aggrieved person can approach the DRT under Section 17 against such measures.
The Court rejected the contention that the DRT's jurisdiction under Sections 17(2) and 17(3) is merely investigative.
The Court also held that although the High Court possesses supervisory jurisdiction under Article 227, it is not required to exercise that jurisdiction where an effective statutory remedy is available.
Since the appellant had already approached the DRT and the proceedings were pending, the High Court found no reason to interfere.
4. Court's Reasoning
The Court focused on the statutory scheme of the SARFAESI Act.
Section 17 gives the DRT jurisdiction to consider applications by persons aggrieved by measures referred to in Section 13(4).
The Court observed that the Section 14 proceedings are not an independent enforcement mechanism divorced from Section 13(4). They are undertaken in furtherance of the secured creditor's measures for obtaining possession of the secured asset.
Consequently, a challenge concerning such possession measures can be raised before the DRT under Section 17.
The Court specifically rejected the argument that the DRT can merely investigate the matter without granting substantive relief. Sections 17(2) and 17(3) provide the DRT with the necessary jurisdiction to examine whether the measures taken by the secured creditor are in accordance with the SARFAESI Act and to grant appropriate relief.
Although Article 227 gives the High Court supervisory jurisdiction, the existence of that constitutional power does not mean that the High Court should ordinarily bypass the statutory remedy created by Parliament.
In the present case, the appellant had already invoked the DRT remedy. Therefore, there was an additional reason for the High Court not to interfere.
5. Relevance to Co-operative Banks
This ruling directly concerns a co-operative bank — The Bangalore City Co-operative Bank Ltd. — exercising SARFAESI powers.
For a co-operative bank using SARFAESI, it reinforces the procedural position that challenges to possession and other enforcement measures should ordinarily be dealt with by the DRT under Section 17 rather than through repeated writ proceedings before the High Court.
It is particularly useful when a borrower:
• challenges a Section 14 possession order before the High Court;
• argues that Section 14 proceedings are outside the scope of Section 17;
• attempts to invoke Article 227 despite having a DRT remedy; or
• approaches the High Court after already instituting proceedings before the DRT.
The ruling therefore supports a co-operative bank in resisting parallel or repeated High Court challenges to SARFAESI enforcement measures, subject to the recognised exceptions to the alternative-remedy rule.
6. Practical Application
For a co-operative bank's SARFAESI litigation, this judgment can be relied upon to argue:
"Once the bank has taken measures under Section 13(4) and proceedings under Section 14 are initiated for obtaining possession, a borrower aggrieved by those measures has an effective statutory remedy under Section 17 before the DRT. The borrower should not ordinarily be permitted to circumvent that remedy by invoking Articles 226/227."
If the borrower has already filed a Section 17 securitisation application before the DRT, the bank has an even stronger procedural objection to a subsequent writ petition concerning the same SARFAESI measures.
The decision does not mean that the High Court can never exercise Article 226/227 jurisdiction in SARFAESI matters. The general exceptions to the alternative-remedy principle continue to apply, including circumstances such as lack of jurisdiction or serious violation of natural justice.
Summary (Kannada)
• ಸೆಕ್ಷನ್ 14ರ ಸ್ವಾಧೀನ ಆದೇಶವನ್ನು ಹೈಕೋರ್ಟ್ನಲ್ಲಿ ಪ್ರಶ್ನಿಸಿದಾಗ;
• ಸೆಕ್ಷನ್ 14ರ ಕ್ರಮವು ಸೆಕ್ಷನ್ 17ರ ವ್ಯಾಪ್ತಿಗೆ ಬರುವುದಿಲ್ಲ ಎಂದು ವಾದಿಸಿದಾಗ;
