H. Chandrashekar v. Ashok Nagar Co-operative Bank Ltd. & Ors.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026:KHC:11441

Key Legal Principles

The important principle is:

A person aggrieved by a SARFAESI measure cannot ordinarily obtain relief under Article 227 by challenging an incidental communication while leaving the substantive SARFAESI measure itself unchallenged.

Where an e-auction has been conducted, the aggrieved person should directly challenge the auction/SARFAESI measure through the legally available remedy, including Section 17 of the SARFAESI Act, and necessary parties such as the auction purchaser should be impleaded where appropriate.

A mere OTS proposal or claim of payment does not automatically invalidate completed SARFAESI proceedings. The actual terms of the OTS and proof of compliance must be established.

Key Legal Principles (Kannada)

Summary (English)

1. Facts

The petitioner was a guarantor for an overdraft facility availed by the principal borrower from Ashok Nagar Co-operative Bank Ltd.

The loan facility had been availed on 21.12.2000. Since the principal borrower failed to repay the dues, the co-operative bank initiated proceedings under the SARFAESI Act.

The bank issued a demand notice under Section 13(2) stating that approximately Rs.25,40,212/- was due. The petitioner replied offering to pay Rs.3,00,000/-, but the bank subsequently proceeded under Section 13(4).

The petitioner approached the DRT and obtained interim protection subject to payment of 25% of the dues. He complied with that condition by making payments totalling Rs.7,00,000/-.

Subsequently, the petitioner claimed that he had made further payments pursuant to an OTS proposal issued by the bank. The bank nevertheless proceeded with an e-auction, and the auction purchaser paid the entire bid amount.

The petitioner then approached the High Court under Article 227 seeking to quash a bank communication dated 20.09.2024 informing him that the auction had taken place.

2. Legal Issue

Whether a borrower/guarantor can invoke Article 227 to challenge a communication relating to a completed SARFAESI auction without directly challenging the underlying SARFAESI measures.

Whether the High Court should interfere when the aggrieved person has an efficacious remedy under Section 17 of the SARFAESI Act.

3. Court's Decision

The High Court declined to grant relief.

The writ petition was disposed of by giving the petitioner liberty to avail an appropriate remedy in accordance with law.

The Court did not interfere with the SARFAESI auction merely on the basis of the challenged communication.

4. Court's Reasoning

The Court observed that the petitioner had challenged only the communication dated 20.09.2024 stating that the auction had taken place.

The Court held that even if that communication were quashed, it would not place the petitioner in a better position.

If the petitioner was actually aggrieved by the e-auction, he ought to have directly challenged the auction proceedings and impleaded the auction purchaser as a necessary party.

The petitioner also relied upon an OTS letter dated 26.08.2024 and claimed that he had paid the entire settlement amount. However, the Court found that there was nothing on record demonstrating payment of the entire OTS amount of approximately Rs.17.50 lakh within the stipulated period.

The Court further noted that the petitioner had not directly challenged the SARFAESI proceedings through the appropriate statutory mechanism.

Since Section 17 of the SARFAESI Act provides an efficacious remedy against measures taken under Section 13(4), the High Court declined to exercise its supervisory jurisdiction under Article 227.

5. Relevance to Co-operative Banks

This is directly relevant to co-operative banks using SARFAESI proceedings for recovery.

The case is particularly useful when a borrower or guarantor approaches the Karnataka High Court after an auction and attacks only:

• a bank communication;

• an auction intimation;

• a consequential letter; or

• some incidental step,

instead of challenging the substantive SARFAESI measure before the DRT.

It also supports the bank's position where the borrower relies upon an OTS proposal but cannot establish compliance with the payment conditions of the OTS.

6. Practical Application

For a co-operative bank facing a writ petition after SARFAESI auction, the following points are practically useful:

1. Identify whether the petitioner has actually challenged the substantive SARFAESI measure or merely an incidental communication.

2. Point out the statutory remedy under Section 17 of the SARFAESI Act.

3. If the auction is already completed, place the auction purchaser's rights and participation before the Court.

4. If the borrower relies upon an OTS, produce the complete OTS letter, payment schedule, expiry date and payment records.

5. Demonstrate whether the borrower actually complied with the OTS conditions.

6. Where the petitioner seeks to challenge the auction itself, insist that the auction purchaser be appropriately impleaded.

The judgment is therefore particularly useful as a procedural defence against attempts to use Article 227 to indirectly reopen SARFAESI recovery proceedings without properly challenging the underlying statutory measures.

Summary (Kannada)

• bank communication;

• auction intimation;

5. Borrower OTS
