The Krishna District Cooperative Central Bank Limited & Ors. v. Dasari Venkata Srinivasa Rao & Ors.

  • Court: Andhra Pradesh High Court
  • Year: 2025
  • Neutral citation: APHC010352472024

Key Legal Principles

According to this Division Bench judgment, the statutory recovery mechanism available under a State Co-operative Societies Act cannot be invoked by a State-level co-operative bank for recovery of banking dues where the RDB Act applies and no corresponding statutory exception or option is provided.

The specific statutory option under Section 19(1A) of the RDB Act is available to multi-State co-operative banks, and the Court treated the absence of a similar provision for State-level co-operative banks as deliberate.

IMPORTANT LIMITATION:

This is an Andhra Pradesh High Court Division Bench ruling and not a Supreme Court ruling. The question involves the interaction of the RDB Act with State co-operative recovery legislation and must therefore be read carefully with the Supreme Court's Constitution Bench decision in Pandurang Ganpati Chaugule and the subsequent statutory amendments.

It should not be treated as a universal proposition that every State co-operative bank in India can never use its State recovery mechanism without first examining the particular State statute and the current RDB/SARFAESI statutory framework.

Key Legal Principles (Kannada)

ಈ Division Bench ತೀರ್ಪಿನ ಪ್ರಕಾರ, RDB Act ಅನ್ವಯಿಸುವ ಸಂದರ್ಭದಲ್ಲಿ ಮತ್ತು State-level co-operative bank ಗೆ ಯಾವುದೇ corresponding statutory exception ಅಥವಾ option ಇಲ್ಲದಿದ್ದರೆ, State Co-operative Societies Act ಅಡಿಯಲ್ಲಿ ಇರುವ recovery mechanism ಅನ್ನು banking dues ವಸೂಲಿಗಾಗಿ ಬಳಸಲಾಗುವುದಿಲ್ಲ.

ಈ ಪ್ರಶ್ನೆಯು RDB Act ಮತ್ತು State Co-operative recovery legislation ನಡುವಿನ ಸಂಬಂಧಕ್ಕೆ ಸಂಬಂಧಿಸಿರುವುದರಿಂದ, ಇದನ್ನು Supreme Court ನ Pandurang Ganpati Chaugule ತೀರ್ಪು ಮತ್ತು ನಂತರದ statutory amendments ಜೊತೆಗೆ ಓದಬೇಕು.

ಪ್ರತಿ State co-operative bank ತನ್ನ State recovery mechanism ಅನ್ನು ಎಂದಿಗೂ ಬಳಸಲು ಸಾಧ್ಯವಿಲ್ಲ ಎಂಬ universal rule ಆಗಿ ಇದನ್ನು ಪರಿಗಣಿಸಬಾರದು.

Summary (English)

1. Facts

Dasari Venkata Srinivasa Rao obtained a loan of Rs.25 lakhs from Krishna District Cooperative Central Bank Limited in 2019.

After he defaulted in repayment, the Bank initiated recovery proceedings under the Andhra Pradesh Co-operative Societies Act, 1964.

The Registrar issued a recovery certificate under Section 71 of the Act.

The borrower challenged the proceedings before the High Court, arguing that because the appellant was a co-operative bank carrying on banking business, recovery of its banking dues fell within the Union legislative field and therefore the Registrar under the State Co-operative Societies Act had no jurisdiction.

The Single Judge accepted the borrower's contention and held that the Bank had to resort to the Recovery of Debts and Bankruptcy Act, 1993 or SARFAESI.

The Bank appealed to the Division Bench.

2. Legal Issue

Whether a State-level co-operative bank can recover dues from its members through the recovery machinery under the State Co-operative Societies Act, or whether recovery must be pursued only through the RDB Act, 1993/SARFAESI framework.

3. Court's Decision

The Division Bench dismissed the Bank's writ appeal.

The Court held that, under the statutory scheme of the RDB Act as it presently stands, a co-operative bank other than a multi-State co-operative bank does not have the statutory option given to a multi-State co-operative bank under Section 19(1A) to choose between the RDB Act and the Multi-State Co-operative Societies Act.

The Court therefore held that the recovery mechanism under the Andhra Pradesh Co-operative Societies Act was no longer available to the appellant co-operative bank for recovery of the debt in question.

The Court upheld dismissal of the Bank's recovery proceedings before the State co-operative authorities.

4. Court's Reasoning

The Court examined the legislative history and the Supreme Court's decisions in Greater Bombay Cooperative Bank Ltd. v. United Yarn Textile (P) Ltd. and Pandurang Ganpati Chaugule v. Vishwasrao Patil Murgud Sahakari Bank Ltd.

The Court noted that Greater Bombay Cooperative Bank had held that co-operative banks were not "banking companies" within Section 5(c) of the Banking Regulation Act for purposes of the RDB Act, and that State co-operative recovery mechanisms were available.

However, the Court observed that the legal position had subsequently developed, particularly after Pandurang Ganpati Chaugule, which recognised that banking activity carried on by co-operative banks falls within Entry 45 of List I and that recovery is an essential part of banking.

The Division Bench then examined Sections 17, 18 and 19 of the RDB Act.

Section 18 creates a bar against other courts or authorities exercising jurisdiction in matters falling within Section 17, subject to the statutory exceptions.

Most importantly, Section 19(1A) expressly gives a multi-State co-operative bank an option to initiate recovery proceedings under the Multi-State Co-operative Societies Act instead of applying under the RDB Act.

The Court treated the absence of a corresponding statutory option for State-level co-operative banks as significant.

Therefore, according to the Division Bench, a State-level co-operative bank could not rely upon its State Co-operative Societies Act recovery mechanism for recovery of banking dues.

5. Relevance to Co-operative Banks

This judgment is important because it addresses a fundamental practical question for a co-operative bank:

"Which statutory forum should the bank use for recovery of a loan from its member?"

For a co-operative-bank lawyer, jurisdiction must be examined before commencing recovery proceedings.

The judgment is particularly relevant to:

• recovery certificates under State Co-operative Societies Acts;

• Registrar/Assistant Registrar recovery proceedings;

• disputes between co-operative banks and members;

• RDB Act jurisdiction;

• SARFAESI versus State co-operative recovery mechanisms;

• legislative competence arguments;

• challenges to recovery proceedings on jurisdictional grounds; and

• distinction between State co-operative banks and multi-State co-operative banks.

6. Practical Application

For a co-operative bank lawyer:

(a) Before filing recovery proceedings, identify whether the bank is a State-level co-operative bank or a multi-State co-operative bank.

(b) Examine the current RDB Act provisions applicable to the bank, particularly Sections 2, 17, 18 and 19.

(c) Do not assume that the mere existence of a recovery provision in the State Co-operative Societies Act automatically establishes jurisdiction.

(d) Examine whether the particular State statute contains an independent recovery mechanism and whether it survives the current Central statutory framework.

(e) Distinguish the legal position of multi-State co-operative banks because Section 19(1A) specifically addresses their option to use the Multi-State Co-operative Societies Act.

(f) Where SARFAESI is being considered, separately examine whether the secured asset and transaction satisfy the requirements of SARFAESI.

(g) In a jurisdictional challenge, the exact statutory text in force on the date of commencement of the recovery proceeding should be placed before the Court.

The practical lesson is that a co-operative bank should decide the recovery forum only after analysing the current statutory interaction between the RDB Act, SARFAESI and the applicable State Co-operative Societies Act.

Summary (Kannada)

ಸಾಲಗಾರರು High Court ಮುಂದೆ ಈ proceedings ಅನ್ನು ಪ್ರಶ್ನಿಸಿ, ಬ್ಯಾಂಕ್ banking business ನಡೆಸುತ್ತಿರುವ co-operative bank ಆಗಿರುವುದರಿಂದ ಅದರ banking dues ವಸೂಲಾತಿ Union legislative field ಗೆ ಸೇರಿದೆ ಮತ್ತು State Co-operative Societies Act ಅಡಿಯಲ್ಲಿ Registrar ಗೆ jurisdiction ಇಲ್ಲ ಎಂದು ವಾದಿಸಿದರು.

Recovery of Debts and Bankruptcy Act,

ಪ್ರಸ್ತುತ RDB Act ನ statutory scheme ಪ್ರಕಾರ, multi-State co-operative bank ಅಲ್ಲದ State-level co-operative bank ಗೆ Section 19(1A) ಅಡಿಯಲ್ಲಿ multi-State co-operative bank ಗೆ ನೀಡಿರುವಂತೆ RDB Act ಮತ್ತು Multi-State Co-operative Societies Act ನಡುವೆ ಆಯ್ಕೆ ಮಾಡುವ statutory option ಇಲ್ಲ ಎಂದು Court ಹೇಳಿತು.

Court, Greater Bombay Cooperative Bank Ltd. v. United Yarn Textile (P) Ltd. ಮತ್ತು Pandurang Ganpati Chaugule v.

Greater Bombay Cooperative Bank ಪ್ರಕರಣದಲ್ಲಿ co-operative banks RDB Act ಗಾಗಿ Banking Regulation Act ನ Section 5(c) ಅಡಿಯಲ್ಲಿ "banking companies" ಅಲ್ಲ ಮತ್ತು State Co-operative Societies Acts ಅಡಿಯಲ್ಲಿ recovery mechanisms ಲಭ್ಯವಿವೆ ಎಂದು Supreme Court ಹೇಳಿತ್ತು.

ಆದರೆ ನಂತರ Pandurang Ganpati Chaugule ತೀರ್ಪಿನಲ್ಲಿ co-operative banks ನಡೆಸುವ banking activity Entry 45, List I ವ್ಯಾಪ್ತಿಗೆ ಬರುತ್ತದೆ ಮತ್ತು recovery banking ನ essential part ಆಗಿದೆ ಎಂದು Supreme Court ಸ್ಪಷ್ಟಪಡಿಸಿತು.

Section 18, Section 17 ವ್ಯಾಪ್ತಿಗೆ ಬರುವ ವಿಷಯಗಳಲ್ಲಿ ಇತರ courts ಅಥವಾ authorities jurisdiction ಬಳಸುವುದಕ್ಕೆ bar ಒದಗಿಸುತ್ತದೆ, subject to statutory exceptions.

ಮುಖ್ಯವಾಗಿ Section 19(1A), multi-State co-operative bank ಗೆ RDB Act ಅಡಿಯಲ್ಲಿ application ಮಾಡುವ ಬದಲು Multi-State Co-operative Societies Act ಅಡಿಯಲ್ಲಿ recovery proceedings ಆರಂಭಿಸುವ option ಅನ್ನು ಸ್ಪಷ್ಟವಾಗಿ ನೀಡುತ್ತದೆ.

ಆದ್ದರಿಂದ State-level co-operative bank ತನ್ನ banking dues ವಸೂಲಿ ಮಾಡಲು State Co-operative Societies Act ನ recovery mechanism ಅನ್ನು ಬಳಸಲು ಸಾಧ್ಯವಿಲ್ಲ ಎಂದು Division Bench ತೀರ್ಮಾನಿಸಿತು.

• State Co-operative Societies Act recovery certificates;

• Registrar/Assistant Registrar recovery proceedings;

• Co-operative banks ಮತ್ತು members ನಡುವಿನ disputes;

• RDB Act jurisdiction;

• SARFAESI ಮತ್ತು State co-operative recovery mechanism ನಡುವಿನ ಸಂಬಂಧ;

• Legislative competence arguments;

• Recovery proceedings ವಿರುದ್ಧ jurisdiction challenges;

• State-level ಮತ್ತು multi-State co-operative banks ನಡುವಿನ ವ್ಯತ್ಯಾಸ.

Co-operative bank

(a) Recovery proceedings ಆರಂಭಿಸುವ ಮೊದಲು bank State-level co-operative bank ಆಗಿದೆಯೇ ಅಥವಾ multi-State co-operative bank ಆಗಿದೆಯೇ ಎಂದು ಗುರುತಿಸಬೇಕು.

(c) State Co-operative Societies Act

(e) Multi-State co-operative banks ನ position ಅನ್ನು ಪ್ರತ್ಯೇಕವಾಗಿ ಪರಿಗಣಿಸಬೇಕು, ಏಕೆಂದರೆ Section 19(1A) ಅವುಗಳಿಗೆ Multi-State Co-operative Societies Act ಬಳಸುವ ನಿರ್ದಿಷ್ಟ option ನೀಡುತ್ತದೆ.
