Smt. Sangeeta v. The State of Karnataka & Ors.
- Court: Karnataka High Court
- Year: 2026
- Neutral citation: 2026:KHC-K:7122-DB
Key Legal Principles
Where recovery proceedings are undertaken under the Karnataka Co-operative Societies Act and a third party claims an interest in the property proposed to be auctioned, the third party should ordinarily pursue the statutory remedy provided under the Act and Rules.
Questions concerning:
(a) bona fide purchase;
(b) competing title claims;
(c) validity/effect of the mortgage;
(d) the right of the Recovery Officer to proceed against the property; and
(e) objections to the auction,
can be examined by the competent authority under the statutory recovery mechanism.
Rule 38(4)(a) specifically provides a mechanism for a third party to contest the auction proceedings.
The High Court may therefore decline to exercise writ jurisdiction where an effective statutory mechanism exists for deciding such objections.
Key Legal Principles (Kannada)
(a) bona fide purchaser ಆಗಿರುವುದೇ;
(b) titleಗೆ ಸಂಬಂಧಿಸಿದ ಹಕ್ಕು;
(c) mortgageನ ಮಾನ್ಯತೆ ಅಥವಾ ಪರಿಣಾಮ;
(d) Recovery Officerಗೆ ಆಸ್ತಿಯ ವಿರುದ್ಧ ಕ್ರಮ ಕೈಗೊಳ್ಳುವ ಅಧಿಕಾರ;
Summary (English)
1. Facts
The appellant, Smt. Sangeeta, purchased an immovable property bearing Site No.112 at Vakkalagera Cotton Market, Nehru Gunj, Kalaburagi, from the third respondent under a registered sale deed dated 23.09.2024.
The property had originally been allotted by the APMC to the third respondent. The APMC subsequently executed a sale deed in favour of the third respondent and permitted him to sell the property.
The third respondent had, however, mortgaged the property in favour of Shri Ganesh Co-operative Bank Ltd. The bank had obtained an award against the third respondent and recovery proceedings were being conducted under the Karnataka Co-operative Societies Act, 1959.
The Recovery Officer of the Karnataka State Co-operative Bank Federation Ltd. thereafter issued an auction notice proposing to sell the property for recovery of the amount due from the third respondent.
The appellant claimed to be a bona fide purchaser and challenged the auction proceedings before the High Court.
She contended that she had purchased the property after obtaining an APMC permission and an encumbrance certificate and that she was not the borrower of the co-operative bank.
The Single Judge directed her to pursue the alternative remedy available under the Karnataka Co-operative Societies Act. The appellant challenged that decision in a writ appeal.
2. Legal Issue
Whether a third-party purchaser who claims to be a bona fide purchaser of property being proceeded against in recovery proceedings under the Karnataka Co-operative Societies Act can directly challenge the Recovery Officer's auction proceedings through a writ petition/writ appeal.
Further, whether questions such as:
• whether the purchaser is a bona fide purchaser;
• whether the property can legally be proceeded against for the borrower's dues; and
• whether the recovery proceedings affect the purchaser's rights,
should first be determined by the Registrar/competent authority under the Karnataka Co-operative Societies Act.
3. Court's Decision
The High Court declined to interfere with the orders of the Single Judge.
It held that the appellant's grievance had to be adjudicated before the Registrar of Co-operative Societies/competent authority under the Karnataka Co-operative Societies Act and Rules.
The Court specifically relied upon the proviso to Section 100, under which complicated questions of fact or law can be dealt with in accordance with Section 71 as if the matter were a dispute referred under Section 70.
The Court also noted that Rule 38(4)(a) enables a third party to contest the auction proceedings.
Therefore, the Court held that the appellant had an effective statutory mechanism to raise her objections.
The writ appeal was accordingly disposed of, with liberty to the appellant to raise her objections before the Recovery Officer or Registrar within 30 days.
The Recovery Officer was directed not to precipitate the matter until the objections were decided.
4. Court's Reasoning
The Court distinguished between the existence of a grievance and the proper forum for adjudicating that grievance.
The appellant raised substantial factual and legal questions concerning her alleged bona fide purchase, the previous title documents, the mortgage, the recovery award and the authority of the Recovery Officer to proceed against the property.
The Court held that these matters were capable of being examined by the statutory authorities under the Karnataka Co-operative Societies Act.
Importantly, the Court referred to the proviso to Section 100, which provides a mechanism where determination of the amount due depends upon complicated questions of fact or law.
The Court also relied upon Rule 38(4)(a), which provides a mechanism for a third party to contest auction proceedings.
Thus, the existence of a third-party purchaser does not by itself require the High Court to decide the title and recovery dispute in writ jurisdiction.
The statutory authority is competent to consider whether the appellant is genuinely a bona fide purchaser and whether the recovery authorities can proceed against the property.
5. Relevance to Co-operative Banks
This is a practically useful Karnataka ruling for co-operative banks conducting recovery under the Karnataka Co-operative Societies Act.
A common situation is that a borrower mortgages property to a co-operative bank and subsequently transfers the property to another person. The purchaser then approaches the High Court claiming to be a bona fide purchaser and seeks to stop the bank's recovery auction.
This judgment supports the position that such a third party cannot necessarily bypass the statutory recovery mechanism and obtain adjudication directly from the High Court.
The bank can rely on the judgment to contend that the purchaser's:
• bona fide purchaser claim;
• title claim;
• objection to attachment/auction;
• challenge to the Recovery Officer's authority; and
• other factual objections
should first be placed before the competent authority under the Karnataka Co-operative Societies Act and Rules.
The judgment is particularly useful because the claimant was not the original borrower but a subsequent purchaser of the secured/recovery property.
6. Practical Application
For a co-operative bank's recovery proceedings in Karnataka, if a subsequent purchaser approaches the High Court challenging an auction, the bank can rely on this decision to argue:
"The petitioner is a third-party purchaser claiming an independent interest in the property. The Karnataka Co-operative Societies Act and Rules provide a statutory mechanism for such third-party objections, including under Rule 38(4)(a). Questions regarding bona fide purchase, title, the effect of the mortgage and the authority of the Recovery Officer are matters which can be adjudicated by the competent statutory authority. Therefore, the writ petition should not be used to bypass the statutory recovery mechanism."
The judgment also gives practical protection to the purchaser: the High Court directed that objections be heard and decided and that the Recovery Officer should not precipitate the matter until the objections were determined.
Therefore, the ruling should not be understood as automatically validating every auction by a co-operative bank. Rather, it establishes the appropriate statutory forum for determining a third party's substantive objections.
For the bank, the important practical point is to ensure that the recovery record, award, mortgage documents, title documents and statutory notices are complete, because the competent authority may have to examine the third party's objections on merits.
Summary (Kannada)
• ಖರೀದಿದಾರರು ನಿಜವಾಗಿಯೂ bona fide purchaser ಆಗಿದ್ದಾರೆಯೇ;
• bona fide purchaser ಎಂಬ ಹಕ್ಕು;
• titleಗೆ ಸಂಬಂಧಿಸಿದ ಆಕ್ಷೇಪಣೆ;
• attachment/auction ವಿರುದ್ಧದ ಆಕ್ಷೇಪಣೆ;
• Recovery Officerನ ಅಧಿಕಾರದ ಪ್ರಶ್ನೆ;
