H.N. Shivakumar v. Mahila Co-operative Bank Ltd. & Ors.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026:KHC:23794

Key Legal Principles

The important principles are:

(a) A borrower challenging measures taken under Sections 13(4) and 14 of the SARFAESI Act ordinarily has the statutory remedy under Section 17 before the DRT.

(b) A borrower cannot ordinarily bypass the DRT merely by filing a writ petition under Articles 226/227 alleging discrepancies in the loan account.

(c) Objections concerning the outstanding amount and the statement of account should ordinarily be raised at the appropriate stage, including in response to the Section 13(2) notice.

(d) A borrower's statement that he is willing to repay the dues does not, by itself, invalidate or suspend SARFAESI proceedings.

(e) Where the High Court declines writ interference because of the statutory remedy, it may nevertheless give appropriate procedural directions concerning the statement of account or payment, depending on the facts.

Key Legal Principles (Kannada)

(a) SARFAESI Act Sections 13(4)

Summary (English)

1. Facts

The petitioner had availed a loan from Mahila Co-operative Bank Ltd. and created a mortgage in favour of the bank.

The bank issued a demand notice under Section 13(2) of the SARFAESI Act on 06.07.2019, stating that approximately Rs.69,40,995/- was outstanding against the loan of Rs.70,00,000/-.

The petitioner disputed the bank's authority and also alleged discrepancies in the loan account, including failure to properly credit certain transactions and errors in calculation of principal and interest.

The bank subsequently issued another demand notice dated 06.09.2021 and a sale notice dated 01.10.2021.

Earlier, the Deputy Commissioner, Tumakuru District, had passed an order dated 06.08.2020 under Section 14 of the SARFAESI Act.

The petitioner approached the High Court under Articles 226 and 227 challenging the SARFAESI notices and the Section 14 order.

The petitioner also stated that he was ready to pay the outstanding amount if the bank supplied a correct statement of accounts.

2. Legal Issue

Whether the High Court should entertain a writ petition challenging SARFAESI measures when the petitioner has an effective statutory remedy before the Debt Recovery Tribunal under Section 17.

Whether alleged discrepancies in the loan account or a willingness to repay the outstanding amount justify interference with SARFAESI proceedings in writ jurisdiction.

3. Court's Decision

The High Court declined to interfere with the SARFAESI proceedings.

The writ petition was disposed of with liberty to the petitioner to avail the appropriate remedy before the DRT within 30 days from receipt of the order.

At the same time, because the petitioner stated that he was willing to pay the outstanding amount, the Court directed the petitioner to approach the bank by 29.04.2026.

The bank was directed to furnish the statement of accounts, after which the petitioner was given liberty to pay the amount within 30 days of receiving the statement.

The demand draft deposited by the petitioner was ordered to be released.

4. Court's Reasoning

The Court noted that the SARFAESI proceedings had commenced in 2019.

When the Section 13(2) notice was issued, the petitioner did not submit a reply raising his objections.

Thereafter, the bank proceeded under Section 13(4), and an order under Section 14 was also passed.

The petitioner subsequently approached the High Court and the proceedings remained stayed for several years.

The Court held that if the petitioner believed that the statement of account was incorrect, he should have raised the objection when the Section 13(2) notice was issued. Under the SARFAESI framework, the bank is required to consider the borrower's representation/objection and communicate its decision.

The Court also rejected the argument that the bank lacked authority to initiate SARFAESI proceedings.

Most importantly, the Court held that the petitioner's willingness to pay the outstanding amount was not by itself a ground for the High Court to entertain the writ petition when the statutory DRT remedy was available.

5. Relevance to Co-operative Banks

This case directly concerns a co-operative bank and is particularly useful in Karnataka SARFAESI litigation.

It is relevant where a borrower files a writ petition alleging:

• incorrect calculation of principal or interest;

• non-credit of payments;

• incorrect statement of account;

• lack of authority of the bank;

• willingness to pay the dues; or

• other objections to SARFAESI measures,

without properly pursuing the DRT remedy.

For the bank, the case supports the preliminary objection that disputes concerning SARFAESI measures should ordinarily be pursued under Section 17 before the DRT.

It also demonstrates that the bank should maintain a clear and updated statement of account because the Court nevertheless directed the bank to furnish the statement when the borrower specifically sought it and expressed willingness to pay.

6. Practical Application

For a co-operative bank receiving a challenge to SARFAESI action, the following records are important:

1. Section 13(2) demand notice and proof of service.

2. The borrower's representation/objection, if any, and the bank's response.

3. Updated statement of account showing principal, interest, charges and credits.

4. Records of all payments made by the borrower.

5. Section 13(4) possession/action records.

6. Section 14 application and order.

7. Sale notice and subsequent enforcement records.

8. Documents establishing the bank's authority to initiate SARFAESI proceedings.

The case is also a practical reminder that, even when relying on the DRT alternative-remedy principle, the bank should be able to immediately produce an accurate statement of account and supporting transaction records.

Summary (Kannada)

SARFAESI proceedings 2019

• principal ಅಥವಾ interest ಲೆಕ್ಕಾಚಾರ ತಪ್ಪಾಗಿದೆ;

• ಕೆಲವು payments credit ಆಗಿಲ್ಲ;

• statement of account ತಪ್ಪಾಗಿದೆ;

• ಬ್ಯಾಂಕಿಗೆ authority ಇಲ್ಲ;

1. Section 13(2) demand notice ಮತ್ತು service proof.

2. Borrowerನ representation/objection ಇದ್ದರೆ ಅದರ copy ಮತ್ತು bankನ reply.

3. Principal, interest, charges ಮತ್ತು creditsಗಳನ್ನು ತೋರಿಸುವ updated statement of account.

5. Section 13(4) possession/action records.

6. Section 14 application ಮತ್ತು order.

7. Sale notice ಮತ್ತು ನಂತರದ enforcement records.

ಈ ಪ್ರಕರಣದ practical lesson ಏನೆಂದರೆ — DRT alternative-remedy objection ಮೇಲೆ bank ಅವಲಂಬಿಸಿದರೂ, accurate statement of account ಮತ್ತು supporting transaction recordsಗಳನ್ನು ತಕ್ಷಣ ಒದಗಿಸಲು ಸಿದ್ಧವಾಗಿರಬೇಕು.
