Mrs. Vibha V. Kamath v. The Recovery Officer & Ors.
- Court: Karnataka High Court
- Year: 2025
- Neutral citation: 2026:KHC:28259
Key Legal Principles
Where the Karnataka Co-operative Societies Act provides an effective statutory appellate remedy against recovery proceedings, a borrower ordinarily should pursue that remedy instead of directly invoking Article 226.
A bona fide litigant who pursued a writ proceeding may, where applicable, seek the benefit of Section 14 of the Limitation Act when subsequently approaching the competent statutory forum.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
The petitioner was facing recovery proceedings in respect of default in repayment of a loan from the Shivamogga District Central Co-operative Bank Ltd.
The Recovery Officer issued auction notices under Form-8 Rule 38(2)(d) and Form-9 Rule 22(7)(e) of the Karnataka Co-operative Societies Rules, 1960.
The petitioner also challenged a sale certificate issued in favour of another respondent.
The petitioner approached the High Court under Article 226 seeking to quash the recovery and auction proceedings.
During the earlier proceedings, the petitioner had stated that because of financial difficulty she was unable to clear the dues. The Court had permitted her to deposit 25% of the outstanding amount and had temporarily restrained confirmation of the auction.
2. Legal Issue
Whether the borrower could directly challenge the recovery and auction proceedings under Article 226 when an effective statutory appellate remedy was available under Section 106 of the Karnataka Co-operative Societies Act.
3. Court's Decision
The High Court dismissed the writ petition.
The Court held that the petitioner had an alternative and efficacious remedy under Section 106 of the Karnataka Co-operative Societies Act
However, liberty was reserved to the petitioner to avail the statutory appellate remedy.
The Court further held that, if an appeal was filed, the petitioner would be entitled to claim the benefit of Section 14 of the Limitation Act for the period spent bona fide pursuing the writ proceedings.
The interim protection against confirmation of the auction was continued for six weeks.
4. Court's Reasoning
The Court did not examine the merits of the petitioner's objections to the recovery and auction.
The decisive consideration was the availability of the statutory appellate remedy under Section 106.
Therefore, the High Court declined to exercise writ jurisdiction and directed the petitioner to pursue the statutory remedy.
5. Relevance to Co-operative Banks
This is useful for co-operative banks because it reinforces the statutory recovery and appellate mechanism under the KCS Act.
A borrower cannot ordinarily bypass the statutory appellate forum merely by filing a writ petition challenging recovery or auction proceedings.
6. Practical Application
When a borrower approaches the High Court against a recovery officer's auction proceedings, the Bank can specifically point out the availability of the statutory appeal under Section 106.
The Bank should nevertheless be prepared to defend the recovery proceedings before the appellate authority because dismissal of the writ petition does not amount to an adjudication on the merits of the borrower's objections.
