Ram Chander Talwar & Anr. v. Devender Kumar Talwar & Ors.

  • Court: Karnataka High Court
  • Year: 2010

Key Legal Principles

A nomination under Section 45-ZA(2) of the Banking Regulation Act, 1949:

- gives the nominee the right to receive the deposit from the bank;

- does not make the nominee the owner of the deposit;

- does not create a separate mode of succession; and

- does not extinguish the rights of legal heirs under the applicable succession law.

Key Legal Principles (Kannada)

Banking Regulation Act, 1949 ರ Section 45-ZA(2) ಅಡಿಯಲ್ಲಿ:

- ನಾಮಿನಿಗೆ ಬ್ಯಾಂಕಿನಿಂದ ಠೇವಣಿ ಹಣವನ್ನು ಸ್ವೀಕರಿಸುವ ಹಕ್ಕು ಇರುತ್ತದೆ;

- ನಾಮಿನಿ ಕೇವಲ ನಾಮನಿರ್ದೇಶನದಿಂದ ಹಣದ ಮಾಲೀಕರಾಗುವುದಿಲ್ಲ;

Summary (English)

1. Facts

The dispute concerned a bank account held by the deceased mother of the parties. One of her sons was the nominee in the account. After her death, the nominee claimed that, by virtue of Section 45-ZA(2) of the Banking Regulation Act, 1949, he became exclusively entitled to the money lying in the account and that his brother had no right over it.

2. Legal Issue

Whether nomination under Section 45-ZA(2) of the Banking Regulation Act makes the nominee the absolute owner of the money deposited in the deceased depositor's bank account, excluding the legal heirs.

3. Court's Decision

The Supreme Court rejected the nominee's claim of absolute ownership.

The Court held that Section 45-ZA(2) gives the nominee the exclusive right to receive the money from the bank after the death of the depositor. However, the nomination does not make the nominee the owner or beneficial successor of the deposit.

The appeal was dismissed.

4. Court's Reasoning

The Court explained that Section 45-ZA(2) places the nominee in the shoes of the deceased depositor only for the purpose of receiving the money from the bank.

The provision does not create ownership in favour of the nominee. The Banking Regulation Act deals with banking and is not a law governing succession.

Therefore, money received by the nominee continues to form part of the estate of the deceased depositor and is ultimately governed by the applicable law of succession.

Thus, the statutory nomination protects the bank by identifying the person entitled to receive the deposit, but it does not determine who ultimately inherits the money.

5. Relevance to Co-operative Banks

This principle is highly useful for co-operative banks dealing with the deposits of deceased customers.

When a depositor dies, the bank may have to determine whether payment can be made to the registered nominee. The nominee's right to receive the amount should not be confused with ultimate ownership or succession to the money.

Accordingly, a co-operative bank should distinguish between:

(a) the bank's obligation to make payment to the nominee in accordance with the applicable banking/nomination provisions; and

(b) disputes between the nominee and legal heirs regarding the ultimate entitlement to the money.

The Supreme Court's reasoning is particularly important where a legal heir later claims that the nominee was only a recipient and that the deposit forms part of the deceased person's estate.

6. Practical Application

For a co-operative bank:

1. Verify the nomination and death of the depositor.

2. Follow the applicable statutory and RBI/banking instructions for payment to the nominee.

3. Maintain proper records of the nomination and payment.

4. Do not treat the nominee merely because of nomination as the ultimate owner of the deceased depositor's estate.

5. Where competing succession claims arise, distinguish the bank's discharge upon valid payment from the separate dispute regarding succession between the claimants.

The central practical point is:

"Nominee = person entitled to receive the deposit from the bank; nominee ≠ automatically the owner of the deposit."
