Shri Shiddheshwar Co-Operative Bank Ltd. v. State of Karnataka & Ors.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026:KHC-K:2479

Key Legal Principles

A cooperative recovery award cannot be sustained merely because it favours the Bank.

Where the statutory adjudicating authority fails to provide proper opportunity of hearing and fails to comply with mandatory procedural requirements, including recording the relevant evidence and documents under Rule 31A, an appellate authority can set aside the award and remit the matter for fresh adjudication.

Key Legal Principles (Kannada)

Summary (English)

1. Facts

Shri Shiddheshwar Co-operative Bank had obtained an award dated 04.12.2017 in proceedings under the Karnataka Co-operative Societies Act. The award was passed ex parte against the borrower.

The borrower subsequently filed an appeal under Section 105 of the Karnataka Co-operative Societies Act before the Karnataka Appellate Tribunal, along with an application for condonation of a delay of 1,457 days.

The Tribunal condoned the delay on payment of costs of ₹2,000. The Bank did not challenge that order.

The Tribunal thereafter examined the merits and found that the Deputy Registrar had not provided the borrower a proper opportunity of hearing and had also failed to record the bank's evidence and the documents relied upon by the Bank as required under Rule 31A.

The Tribunal therefore set aside the award and remanded the dispute for fresh adjudication.

The Bank challenged the Tribunal's order before the High Court.

2. Legal Issue

Whether the High Court should interfere with the Appellate Tribunal's order setting aside an ex parte cooperative recovery award where the original adjudication had violated principles of natural justice and the requirements of Rule 31A.

3. Court's Decision

The High Court dismissed the Bank's writ petition.

It upheld the Tribunal's decision to set aside the ex parte award and remit the matter for fresh adjudication after giving both sides adequate opportunity.

4. Court's Reasoning

The High Court noted that the Tribunal had found that the original authority had not given the borrower a proper opportunity to contest the proceedings.

More importantly, the authority had not even recorded the brief note of the evidence of the Bank and the documents relied upon by the Bank.

The High Court held that the award therefore did not comply with Rule 31A and was passed in violation of principles of natural justice.

The Court also held that the Tribunal's earlier order condoning the 1,457-day delay had attained finality because the Bank had never challenged that order.

Accordingly, the subsequent auction or other developments could not be used by the Bank to undermine the Tribunal's decision to reopen the defective adjudication.

5. Relevance to Co-operative Banks

This is practically important for cooperative banks because recovery proceedings under Section 70 must be conducted with procedural discipline.

Even where the Bank has a genuine recovery claim, an award may be vulnerable if:

• the borrower was not given adequate opportunity;

• the proceedings were conducted ex parte without proper procedural compliance;

• the Bank's evidence is not properly recorded;

• documents relied upon by the Bank are not duly considered; or

• the prescribed procedure under Rule 31A is not followed.

6. Practical Application

For a cooperative bank conducting Section 70 recovery proceedings, the Bank should ensure that its pleadings, loan documents, account statements, notices, evidence and other supporting documents are properly placed before the Registrar/authority and that the record clearly demonstrates compliance with the prescribed procedure.

A strong underlying claim does not cure a procedurally defective award.

Summary (Kannada)

• ತನ್ನ pleadings ಮತ್ತು ದಾಖಲೆಗಳನ್ನು ಸರಿಯಾಗಿ ಸಲ್ಲಿಸಬೇಕು;

• loan documents ಮತ್ತು account statements ದಾಖಲಿಸಬೇಕು;

• ತನ್ನ ಸಾಕ್ಷ್ಯವನ್ನು ಸರಿಯಾಗಿ ದಾಖಲಿಸಬೇಕು;

• ಎದುರುಪಕ್ಷಕ್ಕೆ ಸಮರ್ಪಕ ವಿಚಾರಣಾ ಅವಕಾಶ ನೀಡಲಾಗಿದೆಯೇ ಎಂಬುದನ್ನು ಖಚಿತಪಡಿಸಿಕೊಳ್ಳಬೇಕು;
