Siddappa S/o Lagama Pujari & Ors. v. Smt. Lagamavva W/o Maruti Kesaragoppa & Ors.
- Court: Karnataka High Court
- Year: 2026
- Neutral citation: 2026:KHC-D:6432
Key Legal Principles
Where the competing rights of members over property arise from or depend upon allotments made by a co-operative society, and determination of those rights requires examination of the society's allotment/business decisions, the dispute can fall within Section 70 of the Karnataka Co-operative Societies Act.
In such a case, the statutory mechanism before the Registrar applies and the jurisdiction of the Civil Court is barred in respect of that dispute.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
The dispute concerned agricultural land belonging to the Shivaji Park Tenant Co-operative Farming Society, Raibag.
The plaintiffs and defendants were members of the co-operative society and claimed rights over portions of land on the basis of allotments made by the society.
The plaintiffs filed a civil suit seeking possession of alleged encroached portions of land.
The defendants contended that the dispute could not be decided by the Civil Court because it was essentially a dispute between members concerning allotment of property by the co-operative society and therefore fell within Section 70 of the Karnataka Co-operative Societies Act, 1959.
The trial Court and First Appellate Court nevertheless entertained the suit and granted relief to the plaintiffs.
The matter reached the High Court in a Regular Second Appeal.
2. Legal Issue
Whether a civil suit is maintainable where the dispute is between members of a co-operative society concerning the allotment and possession of property made by the society, or whether such dispute falls within Section 70 of the Karnataka Co-operative Societies Act and must be decided by the Registrar.
3. Court's Decision
The High Court held that the dispute was one between members of the co-operative society concerning the business of the society.
Therefore, Section 70 of the Karnataka Co-operative Societies Act applied.
The Civil Court had no jurisdiction to entertain the dispute.
The High Court consequently allowed the Regular Second Appeal and set aside the judgments and decrees of the Trial Court and First Appellate Court.
4. Court's Reasoning
The Court examined the nature of the dispute rather than merely the form of the relief claimed.
The society was the owner of the land and its principal business included allotting agricultural lands to its members.
The plaintiffs claimed their rights through an allotment made by the society, while the defendants claimed rights based upon a subsequent allotment/re-allotment made by the same society.
Thus, the central question was which member had been validly allotted the disputed land by the society.
The High Court held that this question directly concerned the business of the co-operative society.
At Para 28, the Court specifically concluded that the dispute was between members concerning the business of the society and therefore attracted Section 70.
The Court also distinguished a situation where a person merely seeks to protect an independent possession from a dispute where the very right to possess the property depends upon an allotment made by the co-operative society.
5. Relevance to Co-operative Banks
This principle is useful to co-operative banks because Section 70 covers several disputes concerning the constitution, management or business of a co-operative society.
The judgment demonstrates that the Court will look at the substance of the dispute to determine whether it falls within the statutory co-operative dispute mechanism.
For a co-operative bank, where a dispute between a member and the bank concerns a matter directly connected with the bank's business and falls within Section 70, the bank can examine whether the Civil Court's jurisdiction is excluded and whether the dispute must instead proceed before the Registrar/competent co-operative authority.
6. Practical Application
For a co-operative bank:
• Identify the real nature of the dispute rather than relying only on the relief claimed in the plaint.
• If the dispute substantially concerns the business, management or member relationship of the co-operative society, examine Section 70.
• If the dispute falls within Section 70, the bank can raise the objection that the Civil Court lacks jurisdiction.
• The bank should distinguish cases where the plaintiff asserts an independent civil right merely involving a co-operative society from cases where the disputed right itself originates from the society's decision/allotment/business.
• This judgment is particularly useful where a member attempts to litigate before a Civil Court a matter that is essentially rooted in a decision of the co-operative institution.
