Smt. K. Lalitha v. Hanumanthnagara Co-operative Bank Ltd.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026:KHC:17046

Key Legal Principles

A co-operative society does not become amenable to a writ of mandamus merely because it is registered under the Karnataka Co-operative Societies Act.

For Article 226 jurisdiction against a co-operative society, the petitioner must establish circumstances showing State control or performance of a public duty/statutory function having a public element.

Purely contractual disputes between a borrower and a co-operative bank ordinarily cannot be converted into writ proceedings merely by invoking Article 226.

Where recovery proceedings and auction of secured property have already been concluded, the High Court may decline to entertain a writ petition seeking relief that has become infructuous, particularly where an efficacious alternative remedy exists.

Key Legal Principles (Kannada)

Article 226 ಅಡಿಯಲ್ಲಿ co-operative society ವಿರುದ್ಧ writ jurisdiction ಬಳಸಬೇಕಾದರೆ State control ಅಥವಾ public duty/statutory function having a public element ಇದೆ ಎಂಬುದನ್ನು ತೋರಿಸಬೇಕು.

Summary (English)

1. Facts

The petitioner had availed a loan from Hanumanthnagara Co-operative Bank Ltd. and had furnished original documents relating to the secured property to the bank.

The petitioner approached the Karnataka High Court under Articles 226 and 227 seeking a direction to the co-operative bank to accept the balance loan dues and return the original documents. The petitioner also sought withdrawal of cases initiated by the bank.

During the pendency of the proceedings, the bank proceeded with recovery of the secured asset and conducted a public auction on 11.03.2026.

The bank raised a preliminary objection that a co-operative society registered under the Karnataka Co-operative Societies Act is not, merely by virtue of its registration, "State" or an "other authority" under Article 12 of the Constitution and therefore a writ of mandamus could not ordinarily be issued against it for purely contractual/private-law obligations.

2. Legal Issue

The principal issues were:

(i) Whether a writ petition under Article 226 is maintainable against a co-operative society merely because it is registered under the Karnataka Co-operative Societies Act.

(ii) Whether the High Court can issue a writ of mandamus directing a co-operative bank to perform purely contractual obligations arising out of a loan transaction.

(iii) Whether the Court should entertain a writ challenge after the secured property has already been auctioned, particularly when alternative statutory remedies are available.

3. Court's Decision

The High Court dismissed the writ petition as not maintainable.

The Court held that a co-operative society registered under the Karnataka Co-operative Societies Act does not automatically become "State" or an "other authority" under Article 12.

Unless there is material demonstrating that the co-operative society is State-controlled or is discharging a public duty or statutory function having a public element, a writ of mandamus cannot ordinarily be issued against it for enforcement of purely contractual or private-law obligations.

The Court also held that, since the secured property had already been auctioned on 11.03.2026, the relief originally sought by the petitioner did not survive for consideration.

The petitioner was left free to challenge the auction or seek other appropriate relief before the competent forum in accordance with law.

4. Court's Reasoning

The Court emphasised that Article 226 jurisdiction is not confined only to bodies falling within Article 12, but a writ of mandamus requires the respondent to be performing a public duty or statutory function having a public element.

A co-operative society registered under the Karnataka Co-operative Societies Act remains essentially a private body unless sufficient material establishes State control or discharge of a public duty.

The petitioner's demand for acceptance of loan dues and return of original documents arose from the contractual relationship between borrower and bank. The petitioner had not placed material showing that the respondent bank was discharging a public function in relation to the relief claimed.

The Court therefore found the writ petition itself to be not maintainable.

The Court additionally considered the subsequent auction of the secured property. Since the auction had already been concluded, the original relief had become infructuous. Any challenge to the recovery or auction was required to be pursued before the competent statutory or other forum.

5. Relevance to Co-operative Banks

This judgment is practically important for co-operative banks because borrowers frequently approach the High Court under Article 226 seeking directions concerning loan accounts, repayment, release of documents, recovery proceedings or auction.

The judgment provides a useful jurisdictional objection where the dispute is essentially contractual and does not involve performance of a public duty.

It is particularly relevant when a borrower seeks:

• a mandamus directing acceptance of loan dues;

• return of original title documents;

• withdrawal of recovery proceedings;

• interference with contractual loan obligations;

• cancellation or restraint of an auction; or

• other relief based essentially on the borrower-bank contractual relationship.

6. Practical Application

When a borrower files a writ petition against a co-operative bank, the bank's legal department should examine:

1. Whether the relief claimed arises from a purely contractual loan relationship.

2. Whether the petitioner has produced any material establishing that the bank is State-controlled.

3. Whether the bank is performing any public duty or statutory function having a public element in relation to the particular relief

4. Whether an alternative statutory remedy is available.

5. Whether recovery proceedings have already progressed or the secured asset has already been auctioned.

6. Whether the relief sought has become infructuous because of subsequent developments.

The judgment can therefore be used as a preliminary maintainability objection where a borrower attempts to use Article 226 to obtain relief concerning a private contractual dispute with a co-operative bank instead of pursuing the appropriate statutory or contractual remedy.

Summary (Kannada)

(i) Karnataka Co-operative Societies Act

Co-operative society State controlನಲ್ಲಿದೆ ಅಥವಾ public duty/statutory function having a public element ನಿರ್ವಹಿಸುತ್ತಿದೆ ಎಂಬುದನ್ನು ತೋರಿಸುವ material ಇಲ್ಲದಿದ್ದರೆ, purely contractual ಅಥವಾ private-law obligations ಜಾರಿಗೆ ತರಲು co-operative society ವಿರುದ್ಧ mandamus ನೀಡಲು ಸಾಧ್ಯವಿಲ್ಲ ಎಂದು ನ್ಯಾಯಾಲಯ ಸ್ಪಷ್ಟಪಡಿಸಿತು.

• Loan dues ಸ್ವೀಕರಿಸುವಂತೆ mandamus;

• Original title documents ಹಿಂತಿರುಗಿಸುವಂತೆ ನಿರ್ದೇಶನ;

• Recovery proceedings ಹಿಂಪಡೆಯುವಂತೆ ನಿರ್ದೇಶನ;

• Contractual loan obligationsನಲ್ಲಿ judicial interference;

• Auction ರದ್ದುಪಡಿಸುವುದು ಅಥವಾ ತಡೆಯುವುದು;

2. Bank State controlನಲ್ಲಿದೆ ಎಂದು petitioner ಯಾವುದೇ material ತೋರಿಸಿದ್ದಾರೆಯೇ?

4. Alternative statutory remedy
