Smt. M.R. Shubha v. SVC Co-operative Bank Limited
- Court: Karnataka High Court
- Year: 2026
- Neutral citation: 2026:KHC:13276
Key Legal Principles
Where a third party produces a registered document showing ownership of property sought to be attached in bank recovery proceedings, the Bank cannot simply proceed on an assumption that the transfer was intended to defeat recovery.
If the Bank disputes the genuineness, validity or purpose of the transfer, it must establish the factual and legal basis for that challenge.
An attachment-before-judgment order should not be sustained merely on disputed questions of ownership without the necessary factual foundation.
Key Legal Principles (Kannada)
Summary (English)
1. FACTS
SVC Co-operative Bank Limited had initiated recovery proceedings before the Debt Recovery Tribunal-I, Bengaluru, against the borrower and guarantors for recovery of approximately ₹41.59 crore with interest.
The petitioner's husband was one of the guarantors.
The property in dispute had originally been purchased jointly by the petitioner and her husband in 2005. Subsequently, a registered gift deed dated 13 July 2017 was executed by the husband in favour of the petitioner.
The loan account subsequently became an NPA in 2018.
During the recovery proceedings, the Bank filed an application under Order XXXVIII Rule 5 of the CPC seeking security/attachment before judgment. The DRT passed an order requiring security equivalent to the claim amount.
The petitioner, as a third party claiming ownership of the property, challenged the attachment, contending that the property belonged to her pursuant to the registered gift deed.
The DRT rejected her application, observing that the gift appeared to have been made to defeat the Bank's recovery and that the husband continued to have a 50% interest in the property based on the original 2005 sale deed.
2. LEGAL ISSUE
Whether the DRT could direct attachment/security over the petitioner's property under Order XXXVIII Rule 5 CPC when:
(a) the property stood in the petitioner's name under a registered gift deed;
(b) the property was not mortgaged to the Bank; and
(c) the Bank's allegation that the gift transaction was intended to defeat its recovery involved disputed questions of fact.
3. COURT'S DECISION
The Karnataka High Court allowed the writ petition.
The Court set aside the DRT's order dated 16 December 2020 passed in I.A. No.2284/2020 in O.A. No.1804/2018.
The Court held that, since there was a registered gift deed in favour of the petitioner, the property had to be considered as belonging to her at that stage.
If the Bank wanted to establish that the gift was merely a transaction intended to defeat or prejudice the Bank's recovery rights, the burden was upon the Bank to prove that allegation.
The High Court held that an attachment before judgment could not properly be ordered on the basis of disputed questions of ownership without first establishing the necessary factual foundation.
4. COURT'S REASONING
The Court noted that the property had originally been jointly purchased by the petitioner and her husband in 2005.
However, a registered gift deed had subsequently been executed by the husband in favour of the petitioner.
The Court specifically noted that the property was not mortgaged to the Bank.
The Court therefore held that, as long as the registered gift deed existed, the petitioner had to be treated as the owner of the property.
The Bank could challenge that position by proving that the transaction was intended to defeat the Bank's interests or was otherwise legally ineffective.
But such a determination involved disputed questions of fact.
According to the High Court, such disputed ownership questions could not form the sole basis for an attachment-before-judgment order under Order XXXVIII Rule 5 CPC.
Accordingly, the DRT's order was set aside.
5. RELEVANCE TO CO-OPERATIVE BANKS
This judgment is particularly useful for co-operative banks involved in DRT recovery proceedings.
A borrower or guarantor may transfer property to a spouse or another third party before or during recovery proceedings. The Bank may then seek attachment of that property on the allegation that the transfer was intended to defeat recovery.
This judgment demonstrates that the Bank should not rely merely on the relationship between the transferor and transferee or on the timing of the transaction.
The Bank should collect evidence showing, where applicable:
- the actual consideration or absence of consideration;
- the financial circumstances of the transferor;
- the timing of the transfer;
- the borrower's existing liabilities;
- possession and enjoyment of the property;
- subsequent transactions involving the property; and
- circumstances indicating that the transfer was intended to defeat the Bank's recovery.
6. PRACTICAL APPLICATION
Before filing an application for attachment before judgment against property standing in a third party's name, a co-operative bank should conduct a proper title and transaction review.
If the Bank relies upon a fraudulent or sham transfer, the application should clearly set out the factual circumstances supporting that allegation rather than merely stating that the transfer was made to defeat recovery.
The Bank should also place the relevant registered documents, loan records, dates of default/NPA, correspondence, consideration details and other evidence before the Tribunal.
The practical lesson is that the Bank's recovery rights are important, but attachment before judgment cannot be used as a substitute for proving disputed ownership.
Where a registered transfer exists, the Bank should be prepared to establish why that transfer should not be recognised or why the property can nevertheless legally be proceeded against.
Summary (Kannada)
Recovery Proceedings ನಡೆಯುತ್ತಿದ್ದ ಸಂದರ್ಭದಲ್ಲಿ ಬ್ಯಾಂಕ್ CPCಯ Order XXXVIII Rule 5 ಅಡಿಯಲ್ಲಿ Security/Attachment Before Judgmentಗಾಗಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿತು.
(a) ಆಸ್ತಿ Registered Gift Deed ಮೂಲಕ ಅರ್ಜಿದಾರೆಯ ಹೆಸರಿನಲ್ಲಿದ್ದಾಗ;
Karnataka High Court writ petition
I.A. No.2284/2020 in O.A.
Ownershipಗೆ ಸಂಬಂಧಿಸಿದ disputed questions of fact ಇರುವ ಸಂದರ್ಭದಲ್ಲಿ, ಅಗತ್ಯವಾದ factual foundation ಇಲ್ಲದೆ attachment before judgment ಮಾಡುವುದು ಸರಿಯಲ್ಲ ಎಂದು High Court ಹೇಳಿತು.
- ನಿಜವಾದ consideration ಪಾವತಿಯಾಗಿದೆಯೇ ಅಥವಾ ಇಲ್ಲವೇ;
- transferorನ ಆರ್ಥಿಕ ಪರಿಸ್ಥಿತಿ;
- transfer ನಡೆದ ಸಮಯ;
- ಸಾಲಗಾರನ existing liabilities;
- ಆಸ್ತಿಯ possession ಮತ್ತು enjoyment;
