Smt. Savita W/o Mahadev Hosamani & Ors. v. The Assistant Registrar of Co-operative Societies & Ors.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026:KHC-D:5497

Key Legal Principles

Under Section 105(2) of the Karnataka Co-operative Societies Act, 1959, an appeal against an order, decision or award directing payment of money cannot be considered by the appellate authority unless the prescribed 25% deposit is made.

The judgment therefore reinforces the mandatory nature of the statutory pre-deposit requirement before the Karnataka Appellate Tribunal.

Key Legal Principles (Kannada)

Summary (English)

1. Facts

Late Mahadev Hosamani was the Secretary of Sri Gangadhar Urban Co-operative Society Ltd.

An audit reportedly found misappropriation of ₹98,31,805/-. On the basis of the audit, surcharge proceedings were initiated under Section 69 of the Karnataka Co-operative Societies Act, 1959.

The Assistant Registrar passed a surcharge order dated 31.12.2024 fastening liability on the deceased Mahadev Hosamani and, consequently, his legal representatives.

The legal representatives challenged the surcharge order before the Karnataka Appellate Tribunal in Co-op Appeal No.104/2025.

Along with the appeal, they filed I.A. No.4 seeking exemption from depositing the statutory 25% amount required under Section 105(2) of the KCS Act.

The Karnataka Appellate Tribunal rejected that application. The legal representatives then approached the High Court under Article 226.

2. Legal Issue

Whether the Karnataka Appellate Tribunal could exempt the appellants from the statutory requirement of depositing 25% of the amount due under Section 105(2) of the Karnataka Co-operative Societies Act before their appeal could be considered.

3. Court's Decision

The High Court dismissed the writ petition.

The Court held that deposit of 25% of the award/amount due is a statutory precondition for consideration of an appeal under Section 105(2) of the KCS Act.

Therefore, the Karnataka Appellate Tribunal was justified in refusing to exempt the petitioners from the statutory deposit.

4. Court's Reasoning

The Court noted that the petitioners had admittedly filed an appeal under Section 105 of the KCS Act.

Section 105(2) makes deposit of 25% of the amount due under the order, decision or award a condition for consideration of an appeal.

The High Court therefore found no error in the Tribunal's order refusing exemption and dismissed the writ petition.

Importantly, the High Court did not decide the underlying correctness of the surcharge liability or finally determine whether Mahadev was actually liable for the alleged misappropriation. The issue before the High Court was the statutory deposit requirement.

5. Relevance to Co-operative Banks

This is directly relevant to co-operative banks and co-operative societies involved in surcharge proceedings.

Where an Assistant Registrar passes a monetary surcharge order under the KCS Act and the aggrieved person wants to appeal to the Karnataka Appellate Tribunal, the appellant must comply with the Section 105(2) pre-deposit requirement.

An appellant cannot ordinarily avoid the statutory requirement merely by filing an application seeking complete exemption from the 25% deposit.

6. Practical Application

For a co-operative bank/society:

• If a surcharge order imposes monetary liability, check Section 105(2) before defending or prosecuting the appeal.

• If the appellant has not deposited the required 25%, the statutory objection can be raised before the Karnataka Appellate Tribunal.

• A writ petition challenging refusal to waive the statutory deposit is unlikely to succeed merely on the ground that the appellant disputes the underlying surcharge liability.

• The merits of the surcharge order and the statutory pre-deposit requirement are separate issues. This judgment dealt with the latter.

Summary (Kannada)

No.4 ಸಲ್ಲಿಸಿದರು.
