Sri Basaveshwara Pattana Sahakara Bank Niyamitha v. Canara Bank & Ors. / The General Manager, BSNL v. Canara Bank & Ors.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026:KHC:25587

Key Legal Principles

Where negligent conduct of a telecom service provider or its employee in issuing a duplicate SIM directly enables SIM-swap fraud and results in unauthorised banking transactions, the service provider may incur civil liability for the consequential financial loss.

An employer may be vicariously liable where the employee's wrongful act is sufficiently connected with the employee's authorised functions, even though the employee acted improperly.

A bank should not automatically be held liable for a digital-fraud loss merely because the fraudulent transaction passed through its banking system. Liability requires proof of negligence, deficiency or other actionable fault attributable to the bank.

The judgment also recognises that direct recovery of stolen money reduces the net loss, while insurance proceeds may be treated separately, subject to the insurer's subrogation rights.

Key Legal Principles (Kannada)

Summary (English)

1. Facts

Sri Basaveshwara Pattana Sahakara Bank Niyamitha, a co-operative bank in Shivamogga District, maintained a current account with Canara Bank and used internet banking. The registered mobile number for receiving OTPs was a BSNL mobile number.

Between 06.02.2019 and 07.02.2019, seven unauthorised RTGS/NEFT transactions aggregating to Rs.87,70,000/- were carried out from the co-operative bank’s account.

It was subsequently discovered that unknown persons had obtained a duplicate SIM card relating to the registered mobile number from a BSNL office. By obtaining control over the registered mobile number, the fraudsters obtained the OTPs necessary for the internet-banking transactions.

Rs.30,00,000/- was reverse-credited by Canara Bank and Rs.7,12,238/- was subsequently recovered through the criminal investigation. The remaining loss was Rs.50,50,762/-.

The co-operative bank approached the Permanent Lok Adalat under Sections 22A and 22C of the Legal Services Authorities Act, 1987, claiming compensation from BSNL and Canara Bank.

The Permanent Lok Adalat found BSNL negligent and liable, but awarded only Rs.5,00,000/- with interest. It found Canara Bank not liable.

Both sides approached the High Court.

2. Legal Issue

Whether the negligent issuance of a duplicate SIM card by BSNL, which enabled the fraudsters to obtain OTPs and conduct unauthorised banking transactions, made BSNL civilly liable for the resulting loss suffered by the co-operative bank.

The Court also considered:

(a) whether BSNL was vicariously liable for the conduct of its employee;

(b) whether insurance proceeds and other recoveries reduced BSNL's liability;

(c) whether the Permanent Lok Adalat could be interfered with under Articles 226 and 227; and

(d) whether Canara Bank was liable for the fraudulent transactions.

3. Court's Decision

The High Court held that BSNL was negligent in issuing the duplicate SIM and that such negligence was the proximate cause of the fraudulent transactions.

The Court further held BSNL vicariously liable because the employee who improperly issued the SIM was acting through BSNL's official authority, infrastructure and employment functions.

The Court rejected BSNL's challenge to its liability.

At the same time, the Court upheld the finding that Canara Bank was not liable because no negligence or deficiency on the part of Canara Bank was established.

The High Court modified the Permanent Lok Adalat's award and directed BSNL to pay:

• Rs.50,50,762/- towards the net financial loss;

• 9% interest per annum from 07.02.2019 until actual payment;

• Rs.5,00,000/- towards consequential damages.

If the amount was not paid within three months, interest on the outstanding amount would increase to 12% per annum from the date of default.

The criminal proceedings relating to the fraud were directed to continue independently.

4. Court's Reasoning

The Court found that the registered mobile number was an essential component of the OTP-based two-factor authentication system used for the co-operative bank's internet banking.

The duplicate SIM was issued without proper verification. This enabled the fraudsters to gain control over the OTP channel and consequently conduct the unauthorised transactions.

The Court applied the principle of vicarious liability. The employee was performing the very function for which he was employed — issuance of SIM cards — although he performed that function improperly. Therefore, the act was sufficiently connected with his employment for BSNL to be held vicariously liable.

The Court also distinguished the position of Canara Bank. The banking system required login credentials and OTP authentication, and both authentication layers appeared to have been satisfied when the transactions were processed. The evidence did not establish any specific negligence or deficiency by Canara Bank.

The Court further held that direct recoveries of stolen funds reduce the compensable loss, whereas collateral insurance proceeds do not automatically reduce the liability of the tortfeasor. Thus, after accounting for the recoveries, Rs.50,50,762/- represented the net loss.

The Permanent Lok Adalat had found BSNL liable but had awarded only Rs.5,00,000/- without explaining why the established loss was drastically reduced. The High Court considered this an error apparent on the face of the record and therefore interfered with the quantum under Articles 226 and 227.

5. Relevance to Co-operative Banks

This judgment is particularly useful for co-operative banks because it directly concerns a co-operative bank that suffered a substantial digital-banking fraud.

It provides a practical legal framework for determining responsibility where fraud occurs through compromise of the OTP/mobile-number layer rather than through an established defect in the bank's own authentication system

For co-operative banks, the decision is relevant when:

• a duplicate SIM or SIM-swap enables unauthorised banking transactions;

• a telecom operator's negligence is alleged;

• an employee of a service provider causes the loss while performing an official function;

• compensation is claimed for consequential financial loss;

• insurance proceeds have been received after a cyber fraud;

• criminal proceedings are pending simultaneously with a civil compensation claim; or

• a Permanent Lok Adalat's award gives inadequate compensation despite finding liability.

6. Practical Application

A co-operative bank suffering SIM-swap or OTP-related fraud should preserve the complete electronic trail, including transaction logs, OTP records, registered-mobile-number records, telecom correspondence, bank statements, cyber-crime records, recovery details and insurance documents.

The judgment indicates the importance of establishing the precise causal chain:

unauthorised SIM issuance → control of registered mobile number → interception/receipt of OTP → unauthorised banking transaction → financial loss.

The bank should separately identify amounts recovered directly from the fraud and amounts received through insurance, because the Court treated those categories differently.

The decision also demonstrates that the mere existence of criminal proceedings does not prevent a civil claim based on negligence or deficiency in service. Civil liability is determined on the preponderance-of-probabilities standard, independently of criminal liability.

For co-operative banks, the case can therefore be used as a practical precedent in disputes concerning digital banking fraud, telecom negligence, SIM-swap fraud, vicarious liability and recovery of consequential losses.

Summary (Kannada)

Permanent Lok Adalat BSNL

(a) BSNL ತನ್ನ ಉದ್ಯೋಗಿಯ ಕೃತ್ಯಕ್ಕೆ vicariously liable ಆಗುತ್ತದೆಯೇ;

(b) ವಿಮಾ ಮೊತ್ತ ಮತ್ತು ಇತರ ವಸೂಲಾತಿಗಳು BSNLನ ಹೊಣೆಗಾರಿಕೆಯನ್ನು ಕಡಿಮೆ ಮಾಡುತ್ತವೆಯೇ;

• ರೂ.50,50,762/- — ಶುದ್ಧ ಹಣಕಾಸು ನಷ್ಟಕ್ಕೆ;

• 07.02.2019ರಿಂದ ವಾಸ್ತವಿಕ ಪಾವತಿಯವರೆಗೆ ವರ್ಷಕ್ಕೆ 9% ಬಡ್ಡಿ;

ಈ ಕಾರಣದಿಂದ ಆ awardನಲ್ಲಿ error apparent on the face of the record ಇದೆ ಎಂದು ಹೈಕೋರ್ಟ್ ಹೇಳಿ Articles 226 ಮತ್ತು 227 ಅಡಿಯಲ್ಲಿ ಹಸ್ತಕ್ಷೇಪ ಮಾಡಿತು.

• ಡುಪ್ಲಿಕೇಟ್ SIM ಅಥವಾ SIM-swap ಮೂಲಕ ಅನಧಿಕೃತ ವ್ಯವಹಾರಗಳು ನಡೆದಾಗ;

• Telecom operatorನ negligence ಆರೋಪಿಸಲಾಗುವಾಗ;

• service providerನ ಉದ್ಯೋಗಿ ತನ್ನ ಅಧಿಕೃತ ಕಾರ್ಯ ನಿರ್ವಹಿಸುವ ಸಂದರ್ಭದಲ್ಲಿ ತಪ್ಪು ಮಾಡಿದಾಗ;

• digital fraudನ ಹಣಕಾಸಿನ ಮತ್ತು consequential lossಗಾಗಿ compensation ಕೇಳುವಾಗ;

• cyber fraud ನಂತರ insurance amount ದೊರೆತಾಗ;

• Permanent Lok Adalat
