Sri G.K. Gururajrao v. Union of India & Ors.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026 Karnataka High Court judgment, W.A. No. 1805 of 2025

Key Legal Principles

Where DICGC pays insured amounts to depositors of an insured bank under Section 18A of the DICGC Act, the bank's liability to reimburse DICGC is a statutory liability. The priority given to DICGC under Section 21 is not merely dependent upon the ordinary principles of subrogation.

A statutory scheme can therefore give DICGC a priority for recovery even though DICGC's position would otherwise be different under ordinary insurance principles.

The Court also recognized that DICGC's statutory recovery priority is connected with the public purpose of maintaining the resources necessary for protecting depositors and financial stability.

Key Legal Principles (Kannada)

Summary (English)

1. Facts

The case arose out of the financial difficulties of Sri Guru Raghavendra Sahakara Bank Niyamitha, a co-operative bank in Karnataka.

The Bank had an RBI licence to carry on banking business and had a large number of depositors. After serious financial irregularities were detected, RBI imposed restrictions on the Bank under Section 35A read with Section 56 of the Banking Regulation Act, 1949.

Because the Bank was an insured bank and depositors were unable to freely access their deposits, the Deposit Insurance and Credit Guarantee Corporation (DICGC), acting under the amended DICGC Act, paid insured amounts to eligible depositors.

The Corporation ultimately paid approximately ₹712.35 crore in respect of 22,234 claims. It thereafter demanded repayment from the Bank under Section 21 of the DICGC Act.

The appellant challenged the statutory provisions which permitted DICGC to recover the amounts paid to depositors and which gave DICGC priority in repayment over certain other liabilities of the Bank.

2. Legal Issue

The principal issue was whether Sections 18A and 21 of the DICGC Act, particularly the provisions introduced by the 2021 amendment, were constitutionally invalid because they gave DICGC a priority right to recover the amounts it had paid to depositors.

The appellant argued, among other things, that DICGC's position should be governed by ordinary insurance principles and subrogation, under which an insurer should not obtain a better position than the insured depositor.

3. Court's Decision

The Division Bench dismissed the appeal.

The Court upheld the validity of the challenged provisions and rejected the contention that the statutory priority given to DICGC was manifestly arbitrary or unconstitutional.

The Court held that the amount recoverable by DICGC is not merely a consequence of ordinary contractual subrogation. The liability of the insured bank to reimburse DICGC arises because the statute itself creates that liability.

The Court also held that DICGC does not have to be treated merely like an ordinary depositor whose rights are limited to the rights of the depositor who received the insurance payment.

4. Court's Reasoning

The Court explained that the principal object of the DICGC Act is to protect depositors and maintain stability in the banking system.

Section 18A creates a statutory mechanism under which DICGC becomes liable to pay insured amounts to depositors when banking restrictions prevent them from accessing their deposits.

Under Section 18A(5), once DICGC pays the insured amount, the insured bank becomes liable to DICGC for the amount paid.

The Court recognized that Section 21 gives DICGC a priority position in recovering the amounts it has paid.

The Court accepted that this priority places DICGC in a better position than the depositors to whom the insurance amounts were paid. However, that difference does not by itself make the legislation constitutionally arbitrary.

The important reasoning is that DICGC's recovery right is created by statutory prescription. It is not based solely on the ordinary doctrine of subrogation.

The Court also considered the purpose behind the priority. DICGC requires sufficient funds to continue protecting depositors of failed or restricted banks. Therefore, allowing DICGC to recover its statutory payments with priority has a direct connection with the purpose of the legislation.

The Court further held that the provisions of Regulation 22A permit DICGC to consider the financial condition of an insured bank and, in appropriate circumstances, defer or vary the repayment period.

5. Relevance to Co-operative Banks

This ruling is particularly relevant to co-operative banks because the dispute directly concerned a Karnataka co-operative bank.

It is important for co-operative banks facing RBI restrictions, financial distress, reconstruction, revival proceedings or DICGC intervention.

It clarifies that once DICGC makes payments to eligible depositors under Section 18A, the co-operative bank cannot simply argue that DICGC has only the same recovery rights as the individual depositors.

The statutory liability under Section 18A(5) and the recovery mechanism under Section 21 must be considered independently of ordinary contractual subrogation principles.

The judgment is also useful for understanding the interaction between the Banking Regulation Act, DICGC Act and the Karnataka Co-operative Societies Act in the context of a co-operative bank.

6. Practical Application

A lawyer representing a co-operative bank can use this judgment when dealing with:

• DICGC demands for repayment of insurance amounts paid to depositors;

• disputes concerning the priority of DICGC's recovery;

• challenges to the validity of Sections 18A and 21 of the DICGC Act;

• arguments based on ordinary insurance principles or subrogation;

• disputes concerning whether DICGC must wait until liquidation before seeking repayment;

• negotiations concerning deferment or restructuring of DICGC repayment;

• interpretation of Regulations 22 and 22A of the DICGC Regulations.

An important practical point is that the judgment does not mean that DICGC can ignore the statutory framework. Regulation 22A specifically recognizes circumstances in which repayment can be deferred or varied after considering the financial position and cash-flow capability of the bank.

The judgment therefore needs to be read together with Sections 18A and 21 of the DICGC Act and Regulations 21A and 22A of the DICGC Regulations.

Summary (Kannada)

• DICGC insurance amount repayment demand ಬಂದಾಗ;

• DICGC recovery priority ಕುರಿತು ವಿವಾದವಿದ್ದಾಗ;

• DICGC Actನ Sections 18A ಮತ್ತು 21ರ constitutional validity ಪ್ರಶ್ನಿಸಿದಾಗ;

• ಸಾಮಾನ್ಯ insurance subrogation ತತ್ವದ ಆಧಾರದ ಮೇಲೆ ವಾದ ಬಂದಾಗ;

• DICGC liquidation ಆಗುವವರೆಗೆ recovery ಮಾಡಬಾರದು ಎಂಬ ವಾದವಿದ್ದಾಗ;

• DICGC repayment deferment ಅಥವಾ restructuring ಕುರಿತು ಚರ್ಚಿಸುವಾಗ;
