Sri. Gajanan S/o Govindarao Velangi v. The Deputy Registrar of Co-operative Credit Societies, Belagavi & Ors.

  • Court: Karnataka High Court
  • Year: 2026
  • Neutral citation: 2026:KHC-D:6660

Key Legal Principles

Section 70 of the Karnataka Co-operative Societies Act, 1959 is confined to disputes touching the constitution, management or business of a co-operative society.

It cannot be treated as a general forum for every civil claim against a co-operative bank.

Where the substance of a claim is recovery of damages for alleged negligence, breach of duty, business loss or consequential financial loss, and determination of the claim requires extensive evidence regarding causation and quantum of damages, such a claim falls outside the limited adjudicatory scope of Section 70.

Key Legal Principles (Kannada)

Alleged negligence, breach of duty, business loss ಅಥವಾ consequential financial lossಗಾಗಿ damages ಕೇಳಲಾಗಿದ್ದು, ಅದನ್ನು ನಿರ್ಧರಿಸಲು causation ಮತ್ತು quantum of damages ಕುರಿತು ವ್ಯಾಪಕ evidence ಅಗತ್ಯವಿದ್ದರೆ, ಅಂತಹ claim Section 70ರ ಸೀಮಿತ adjudicatory jurisdictionನ ಹೊರಗೆ ಬರುತ್ತದೆ.

Summary (English)

1. FACTS

The petitioner was a member of Maratha Co-operative Urban Bank Ltd. He had availed a commercial loan/cash-credit facility from the Bank.

According to the petitioner, the Bank failed to renew his cash-credit facility within the stipulated time. He alleged that this affected his business and caused financial losses.

The Bank had separately initiated recovery proceedings against him under the Karnataka Co-operative Societies Act, 1959. Those proceedings resulted in an award directing the petitioner to pay ₹5,36,526/-.

While contesting the Bank's recovery proceedings, the petitioner also initiated an independent dispute under Section 70 of the Karnataka Co-operative Societies Act, claiming ₹64,49,888/- as damages.

The claim included alleged loss of profits, employee salary, provident fund, gratuity, electricity charges, telephone charges, municipal taxes, excess interest and compensation for mental agony and harassment.

The Deputy Registrar rejected the claim. The Karnataka Appellate Tribunal affirmed that decision. The petitioner therefore approached the High Court under Articles 226 and 227.

2. LEGAL ISSUE

Whether a member of a co-operative bank can maintain a claim under Section 70 of the Karnataka Co-operative Societies Act, 1959 for large-scale damages and compensation allegedly caused by the Bank's failure to renew a cash-credit facility and the resulting business losses.

3. COURT'S DECISION

The Karnataka High Court dismissed the writ petition.

The Court upheld the concurrent findings of the Deputy Registrar and the Karnataka Appellate Tribunal that the petitioner's claim was not maintainable under Section 70 of the Karnataka Co-operative Societies Act.

The Court held that the claim was essentially a civil claim for damages arising from alleged breach, negligence or inaction by the Bank.

Such a claim required a detailed examination of disputed facts, evidence regarding causation and assessment of the actual damages suffered.

Therefore, the authorities under the Karnataka Co-operative Societies Act could not adjudicate such a claim merely because the dispute was against a co-operative bank.

4. COURT'S REASONING

The Court examined the substance of the claim rather than merely its form.

The petitioner had described his claim as a dispute under Section 70, but the substance of the claim was compensation for alleged financial loss and business consequences arising from the Bank's alleged failure to renew the cash-credit facility.

The Court observed that deciding such a claim would require determination of several disputed questions, including:

- whether the Bank had a legal duty to renew the cash-credit facility;

- whether the Bank actually failed to perform that duty;

- whether that failure caused the alleged business losses;

- whether the various expenses claimed were actually incurred; and

- what amount of damages, if any, was legally recoverable.

Such questions require oral and documentary evidence and a detailed adjudication similar to a civil trial.

The Court therefore held that Section 70 cannot be expanded to cover every type of civil claim merely because one of the parties is a co-operative society.

5. RELEVANCE TO CO-OPERATIVE BANKS

This judgment is practically relevant to Karnataka co-operative banks because borrowers or members may sometimes attempt to convert contractual or commercial disputes with the Bank into disputes under Section 70 of the Karnataka Co-operative Societies Act.

The judgment gives the Bank a useful jurisdictional objection where the claimant seeks substantial damages for alleged business losses.

The Bank can examine the substance of the claim and contend that the dispute is not merely a dispute touching the business of the co-operative society, but a civil claim requiring a full adjudication of contractual duties, causation and damages.

6. PRACTICAL APPLICATION

When defending a Section 70 claim for damages against a co-operative bank, the Bank should examine:

1. The precise legal duty allegedly owed by the Bank;

2. The contractual terms governing the loan or cash-credit facility;

3. Whether renewal of the facility was automatic or subject to Bank approval;

4. The alleged act or omission of the Bank;

5. The causal connection between that act and the alleged business loss;

6. The documents supporting each individual head of damages; and

7. Whether determination of the claim would require a detailed civil-trial-type examination of evidence.

If the claim principally seeks compensation for business losses, mental agony, loss of profits and consequential expenses, the Bank can raise the objection that Section 70 is not the appropriate statutory forum.

The important practical point is that the jurisdiction of the co-operative authorities depends on the real nature of the dispute, not merely on the claimant describing the proceeding as a Section 70 dispute.

Summary (Kannada)

ಅವರ claimನಲ್ಲಿ loss of profit, employee salary, provident fund, gratuity, electricity charges, telephone charges, municipal taxes, excess interest ಮತ್ತು mental agony/harassmentಗಾಗಿ damages ಮುಂತಾದವುಗಳನ್ನು ಒಳಗೊಂಡಿದ್ದರು.

Karnataka High Court writ petition

1. ಬ್ಯಾಂಕಿನ ಮೇಲೆ ಇದೆ ಎಂದು ಹೇಳಲಾಗಿರುವ ನಿಖರವಾದ legal duty;

2. Loan/Cash Credit Facilityಯ contractual terms;

3. Facility renewal ಸ್ವಯಂಚಾಲಿತವಾಗಿತ್ತೇ ಅಥವಾ Bank approvalಗೆ ಒಳಪಟ್ಟಿತ್ತೇ;

4. ಬ್ಯಾಂಕಿನ alleged act ಅಥವಾ omission;

5. ಆ act/omission ಮತ್ತು alleged business loss ನಡುವಿನ causal connection;

6. ಪ್ರತಿಯೊಂದು head of damagesಗೆ supporting documents; ಮತ್ತು

Claimನ ಮುಖ್ಯ ಸ್ವರೂಪ business losses, mental agony, loss of profits ಮತ್ತು consequential expensesಗಾಗಿ compensation ಪಡೆಯುವುದಾಗಿದ್ದರೆ, Section 70 ಸೂಕ್ತ statutory forum ಅಲ್ಲ ಎಂಬ objection ಅನ್ನು ಬ್ಯಾಂಕ್ ಎತ್ತಬಹುದು.
