Sri V. Krishnaiah (Since Deceased) by LRs v. The Bangalore City Co-operative Bank Ltd. & Ors.
- Court: Karnataka High Court
- Year: 2025
- Neutral citation: 2025:KHC:4814
Key Legal Principles
Where a competent court has expressly permitted a co-operative bank to pursue recovery against the legal heirs of a deceased borrower in their capacity as legal heirs, and that direction has attained finality, the legal heirs cannot subsequently insist that an entirely fresh recovery proceeding must necessarily be initiated.
The effect of an earlier judicial order must be determined from the actual terms of that order.
Further, where legal heirs have been given notice and a genuine opportunity to contest the proceedings but fail to participate, they cannot ordinarily rely upon principles of natural justice merely to reopen or delay the recovery proceedings.
Key Legal Principles (Kannada)
Summary (English)
1. FACTS
Sri V. Krishnaiah had obtained a loan from the Bangalore City Co-operative Bank Ltd.
The Bank initiated recovery proceedings against him before the Assistant Registrar of Co-operative Societies on 31 May 1996.
However, Krishnaiah had already died on 6 September 1994, i.e., before the Bank initiated the recovery proceedings.
An award was nevertheless initially passed against the deceased borrower.
The legal heirs challenged the proceedings on the ground that proceedings initiated against a dead person were illegal. The matter went through several rounds before the Karnataka Appellate Tribunal and the High Court.
In an earlier writ petition, W.P. No. 7275/2007, the High Court quashed the orders bringing the legal heirs on record but expressly gave the Bank liberty to pursue the matter against them in their capacity as legal heirs, while keeping their legal contentions open.
The Bank's appeal against that order in W.A. No. 1677/2009 was dismissed, thereby confirming the liberty granted to the Bank.
After remand, the Joint Registrar issued notice to the legal heirs through RPAD and also by substituted service through newspaper publication. The legal heirs did not participate in the proceedings before the Joint Registrar.
The Joint Registrar thereafter passed an award holding the legal heirs liable for the loan amount. The Karnataka Appellate Tribunal confirmed the award.
The legal heirs again approached the High Court, arguing that the Bank ought to have initiated an entirely fresh recovery proceeding against them because the original proceeding had been instituted against a person who was already dead.
2. LEGAL ISSUE
Whether a co-operative bank, after an earlier proceeding was initiated against a borrower who had already died, could continue the recovery proceedings against the borrower's legal heirs where an earlier High Court judgment had expressly permitted the Bank to pursue the matter against those persons in their capacity as legal heirs.
Whether the Bank was required to initiate a completely fresh proceeding against the legal heirs.
3. COURT'S DECISION
The Karnataka High Court dismissed the writ petition.
The Court held that the Bank was justified in continuing the proceedings against the petitioners as legal heirs.
A fresh and independent recovery proceeding was not required in the circumstances of this case because the earlier High Court judgment in W.P. No. 7275/2007 had specifically granted the Bank liberty to pursue the matter against the petitioners in their capacity as legal heirs.
The Division Bench had subsequently confirmed that position in W.A. No. 1677/2009.
The High Court therefore confirmed the award dated 12 January 2012 passed by the Joint Registrar and the Karnataka Appellate Tribunal's order dated 15 February 2019.
The writ petition was dismissed with costs of ₹5,000/- payable to the Karnataka Legal Services Authority.
4. COURT'S REASONING
The Court first acknowledged the important fact that the original proceedings had indeed been initiated against a person who was already dead.
The Court noted that this issue had already been considered in the earlier litigation.
The earlier High Court order did not simply permit continuation of the original proceeding against the deceased person. Instead, it specifically gave the Bank liberty to pursue the matter against the present petitioners in their existing capacity as legal heirs and allowed them to raise all legal contentions available to them.
That order was challenged by the Bank in W.A. No. 1677/2009, but the Division Bench confirmed the Single Judge's order.
Consequently, the legal heirs could not subsequently contend that the earlier order required the Bank to start an entirely new proceeding.
The Court also noted that the legal heirs had participated in the earlier rounds of litigation before the Tribunal and High Court and were aware of the proceedings.
After remand, notices were issued to them by RPAD and through newspaper publication. They nevertheless did not effectively participate before the Joint Registrar.
The Court held that principles of natural justice cannot be invoked where a party had a real opportunity to participate but deliberately failed to utilise that opportunity.
The Court therefore concluded that the Bank had acted in accordance with the liberty granted by the earlier High Court orders.
5. RELEVANCE TO CO-OPERATIVE BANKS
This judgment is particularly relevant to co-operative banks conducting recovery proceedings under the Karnataka Co-operative Societies Act.
A borrower may die before or during recovery proceedings. Questions can then arise regarding:
- whether the proceedings against the deceased are valid;
- whether legal heirs can be brought on record;
- whether a fresh proceeding is necessary;
- what capacity the legal heirs are being proceeded against in; and
- whether the legal heirs have received a proper opportunity to contest the claim.
The judgment demonstrates the importance of obtaining and preserving a clear judicial order regarding how the recovery proceeding is to continue after the death of the borrower.
It also demonstrates that the Bank should not simply proceed against legal heirs without procedural safeguards. The legal heirs must be brought on record in accordance with the applicable order and must be given an effective opportunity to contest the claim.
7. PRACTICAL APPLICATION
When a borrower dies during or before recovery proceedings, a co-operative bank should immediately verify:
1. The exact date of death of the borrower;
2. The date on which the recovery proceeding was instituted;
3. Whether the original proceeding was instituted against the borrower before or after death;
4. Whether any previous court or tribunal has already issued directions concerning the legal heirs;
5. Whether the legal heirs have been formally brought on record;
6. Whether the legal heirs have been properly served;
7. Whether they have been given an opportunity to raise their legal and factual objections; and
8. Whether the Bank's subsequent action is consistent with the wording of the earlier judicial orders.
If an earlier High Court or Tribunal order specifically permits the Bank to proceed against the legal heirs, the Bank should place that order on record and conduct the subsequent proceedings strictly within the scope of that permission.
This judgment is also a useful reminder that procedural history matters greatly in co-operative recovery litigation. A later court will examine what earlier courts actually ordered rather than allowing a party to reopen an issue merely by describing the original proceeding as having been initiated against a deceased person.
Summary (Kannada)
Bank ಆ ಆದೇಶವನ್ನು W.A.
Karnataka High Court writ petition
ಈ order ವಿರುದ್ಧ Bank W.A. No.1677/2009ರಲ್ಲಿ appeal ಸಲ್ಲಿಸಿದರೂ, Division Bench Single Judgeನ order ಅನ್ನು ದೃಢಪಡಿಸಿತು.
Borrower recovery proceedings
- deceased borrower ವಿರುದ್ಧದ proceedings valid ಆಗಿದೆಯೇ;
- legal heirs ಅವರನ್ನು recordಗೆ ತರಬಹುದೇ;
- fresh proceeding ಅಗತ್ಯವಿದೆಯೇ;
1. Borrowerನ ಮರಣದ ನಿಖರ ದಿನಾಂಕ;
2. Recovery proceeding ಆರಂಭಿಸಿದ ದಿನಾಂಕ;
3. Original proceeding borrower ಬದುಕಿದ್ದಾಗ ಆರಂಭವಾಗಿತ್ತೇ ಅಥವಾ ಮರಣದ ನಂತರವೇ;
4. Legal heirsಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಯಾವುದೇ ಹಿಂದಿನ court ಅಥವಾ tribunal order ಇದೆಯೇ;
5. Legal heirsರನ್ನು ಅಧಿಕೃತವಾಗಿ recordಗೆ ತರಲಾಗಿದೆಯೇ;
6. ಅವರಿಗೆ ಸರಿಯಾಗಿ notice ನೀಡಲಾಗಿದೆಯೇ;
