The Dhanashree Co-Op. Bank Ltd. v. The State of Karnataka & Ors
- Court: Karnataka High Court
- Year: 2026
- Neutral citation: 2026:KHC-D:6127
Key Legal Principles
Where a co-operative bank has furnished or agrees to furnish the documents legitimately sought in proceedings before the co-operative authorities, the dispute concerning the notice may become unnecessary.
The judgment also demonstrates that loan records and property-related documents maintained by a co-operative bank can become relevant in statutory enquiry proceedings under the KCS Act.
Key Legal Principles (Kannada)
Summary (English)
1. Facts
Dhanashree Co-operative Bank had granted financial assistance to late Kiran Pandurang Patil after verification of his work order and immovable properties.
A dispute subsequently arose within the borrower's family concerning certain joint-family properties which were allegedly connected with the loan transaction.
Family members sought information from the Bank concerning the loan account, documents and alleged encumbrances.
The Bank initially did not furnish all the information sought. Complaints were thereafter made before the Joint Registrar and other co-operative authorities.
An enquiry under Section 64 and subsequently proceedings under Section 65 of the Karnataka Co-operative Societies Act were initiated, with allegations that the Bank had violated RBI norms and had furnished incorrect information concerning the properties.
The Bank challenged a notice directing it to furnish the relevant records and information.
2. Legal Issue
Whether the co-operative authorities could require the Bank to furnish the relevant loan documents and information pursuant to complaints and an enquiry under the Karnataka Co-operative Societies Act.
3. Court's Decision
The High Court allowed the Bank's writ petition and quashed the impugned notice.
However, the Bank had agreed before the Court to furnish the documents and information sought and to affix its official seal on the relevant documents.
The Court directed the Bank to issue the documents with the required seal within 15 days.
4. Court's Reasoning
The Court noted that the Bank had already furnished substantial information and had agreed to provide the remaining documents.
Since the Bank had agreed to comply with the information requirement, the Court found that the impugned notice could be quashed.
5. Relevance to Co-operative Banks
This case is useful for banks facing demands from co-operative authorities for production of loan records.
It shows the importance of maintaining a clear documentary record concerning:
• loan sanction and disbursement;
• security documents;
• property verification;
• encumbrance details;
• communications with borrowers and family members; and
• compliance with regulatory requirements.
6. Practical Application
When a Registrar/Deputy Registrar seeks records during an enquiry, the Bank should carefully identify the statutory basis of the demand and preserve a complete record of what documents have already been supplied.
If the Bank agrees to furnish documents, compliance should be properly documented and authenticated.

• loan sanction ಮತ್ತು disbursement ದಾಖಲೆಗಳು;
• security documents;
• property verification;
• encumbrance details;
• borrower/family members ಜೊತೆಗಿನ correspondence; ಮತ್ತು
• regulatory compliance ದಾಖಲೆಗಳನ್ನು
